Common use of Operation Requirements Clause in Contracts

Operation Requirements. During the Term, the User must carry out any works on the Designated Facility on the following basis: (a) pursuant to plans and specifications previously approved in writing by the Manager and all Local or Public Authorities; (b) only for the purposes connected with the Permitted Use and not for any other purposes; and (c) with all proper care, skill and diligence; FOR INFORMATION ONLY (d) in accordance with Good Industry Practices; (e) in compliance with all applicable Laws and regulations and the requirements of all relevant Local or Public Authorities; (f) in a proper, efficient and workmanlike manner exercising due care and skill; (g) using materials which are in good condition and suitable to the purpose for which they are intended; (h) in such a manner so as to prevent Contamination or Pollution of the Designated Facility and any adjoining land including from: (i) storm water or other run-off; (ii) waste materials arising from the works and use and occupancy of the Designated Facility by making adequate provision for the collection and disposal of those waste materials; and (iii) fill, building materials or other rubbish from or arising out of the works. (i) in a manner which complies with all Authorisations and any relevant Law or standard; and (j) otherwise to the satisfaction of DevelopmentWA.
