Common use of Operational Commitments Clause in Contracts

Operational Commitments. To keep open and use the Mobile Unit for the purpose hereinbefore authorised during usual business hours; To obtain and maintain throughout the duration of this Lease a food hygiene rating of 3 or above and to notify the Council of any change of rating To permit the Council or it’s duly authorised servants or agents to enter the Mobile Unit at all reasonable times for the purpose of inspecting the condition thereof Ensure that all electrical equipment and appliances comply with all relevant electrical safety regulations and standards; Be responsible for carrying out Portable Appliance Testing (PAT) or any other legally required electrical safety checks on all electrical equipment used at the Mobile Unit, at regular intervals, in accordance with applicable laws and regulations; Provide the Landlord with valid up to date certificates evidencing compliance with electrical testing requirements upon request and no less than once annually; The Tenant shall not install, modify or interfere with any fixed electrical installations on the Land without prior written consent of the Landlord. Any electrical equipment found to be faulty, unsafe or non-compliant with applicable regulations must be removed or repaired immediately at the Tenants expense. Allow the Landlord to inspect electrical equipment and request evidence of compliance at reasonable intervals, provided appropriate notice is given. The Tenant shall comply with all obligations on the Landlord relating to the Third-Party Rights insofar as those obligations relate to the Site and shall not do anything (even if otherwise permitted by this lease) that may interfere with any Third-Party Rights. The Tenant shall allow the Landlord, and any other person authorised by the terms of any of the Third-Party Rights to enter the Site or Land in accordance with its terms. The Tenant shall pay the Annual Rent in respect of it by equal instalments in advance on or before the Rent Payment Dates and the first instalment shall be paid on the date of this lease and shall be the proportion, calculated on a daily basis, for the period from and including the date of this lease until the day before the next Rent Payment Date. Payments of Annual Rent in respect of it shall be made by banker's standing order or by any other method that the Landlord reasonably requires at any time by giving notice to the Tenant.
