OPERATIONS PERSONNEL/DRIVERS. 14.1 Contractor shall provide a sufficient number of qualified subcontracted drivers and support personnel to assure District of continuous, reliable, safe, and on time service. 14.2 Contractor shall take reasonable steps to ensure that its employees and subcontracted personnel act professionally and appropriately around all students and District staff. Contractor shall not knowingly permit drivers to smoke on a vehicle, or to violate any federal or state law related to the operation of a vehicle while intoxicated or under the influence of any prohibited substance. 14.3 Contractor shall be responsible for providing and discharging subcontractors to perform its obligations hereunder. However, District shall have the right to request Contractor to remove from service to District any employee or subcontractor who, in District’s sole discretion, is deemed unsuitable for the performance of transportation services for District; provided that District shall make such request in writing, state the reasons therefore and include any supporting documentation, and provided further that such request does not violate applicable local, state or federal laws, rules or regulations. To the extent permitted by law, District shall indemnify, defend, and hold Contractor harmless from and against all claims, expenses, or liabilities by or to a removed Contractor or any subcontractors arising from the removal of that individual based on the District’s request. 14.4 Contractor shall provide drivers that are fully qualified, trained and licensed as required by applicable law. Contractor agrees that each driver shall: 14.4.1 Possess a valid drivers’ license or permit required for any smaller passenger vehicle. 14.4.2 Possess a satisfactory driving record and criminal history record, after review of such records prior to employment and periodically thereafter to the extent required by applicable law. 14.4.3 Prior to employment and periodically thereafter, contracted drivers will, undergo such drug and alcohol testing to verify that the driver is not engaged in any prohibited or unsafe vehicle operations. Any driver that fails a drug or alcohol test or refuses to take such test will be subject to immediate disqualification.

Contractor shall not knowingly permit its drivers to smoke on the bus, to drink any intoxicating beverage, or to be under the influence of drugs or alcohol while operating any bus. 19.3 Contractor shall be responsible for hiring and discharging personnel employed by Contractor to perform its obligations hereunder. However, Network shall have the right to request Contractor to remove from service to Network any employee who, in Network’s sole discretion, is deemed unsuitable for the performance of transportation services for Network; provided that Network shall make such request in writing, state the reasons therefore and include any supporting documentation, and provided further that such request does not violate applicable local, state or federal laws, rules or regulations. 19.4 Contractor shall provide qualified driver/trainers and qualified drivers, trained and licensed in accordance applicable laws and the rules and regulations of Network. Not less than sixty (60) days prior to the start of any school year, Contractor shall advise Network of Contractor’s driver training and qualification requirements. Contractor agrees that each driver shall at a minimum: 19.4.1 Possess a valid license or permit issued by this State authorizing such person to operate a school bus. 19.4.2 Be certified by a duly licensed medical practitioner as medically qualified and free of medical or physical conditions, which, absent reasonable accommodation, would limit safe operation of a school bus. The physical examination shall be conducted prior to employment and periodically thereafter. 19.4.3 Possess a satisfactory driving record and criminal history record, after review of such records prior to employment and periodically thereafter to the extent permitted or available by law. Such criminal history record shall be determined via completion of a Louisiana Bureau of Criminal Identification (LCBI) background check, as required by Bulletin 126, and Contractor shall provide Network with verification that such background checks have been completed for any driver or other employee who will interact with students. 19.4.4 Prior to employment and from time-to-time thereafter, to the extent permitted ...

Contractor shall not knowingly permit its drivers to smoke on the bus, to drink any intoxicating beverage, or to be under the influence of drugs or alcohol while operating any bus. 14.3 Contractor shall be responsible for hiring and discharging personnel employed by Contractor to perform its obligations hereunder. However, District shall have the right to request Contractor to remove from service to District any driver, aide or monitor who, in District’s sole discretion, is deemed unsuitable for the performance of transportation services for District; provided that District shall make such request in writing, state the reasons therefore and include any supporting documentation, and provided further that such request does not violate applicable local, state or federal laws, rules or regulations. Unless prohibited by law, District shall indemnify, defend, and hold Contractor harmless from and against all claims, expenses, or liabilities by or to a removed Contractor employee arising from the removal of that employee based on the District’s request. 14.4 Contractor shall provide qualified drivers/trainers and qualified drivers, trained and licensed in accordance with applicable laws and the rules and regulations of District. Prodigy shall not knowingly permit its drivers to smoke on the vehicle, to drink any intoxicating beverage, or to be under the influence of drugs or alcohol while operating any vehicle. 14.3 Prodigy shall be responsible for hiring and discharging personnel employed by Prodigy to perform its obligations hereunder. To the extent permitted by law, Client shall indemnify, defend, and hold Prodigy harmless from and against all claims, expenses, or liabilities by or to a removed Prodigy employee arising from the removal of that employee. 14.4 Prodigy shall provide qualified driver/trainers and qualified drivers, trained and licensed in accordance applicable laws and the rules and regulations of the State of California. Client agrees that each driver shall: 14.4.1 Possess a valid license or permit issued by this State authorizing such person to operate a shuttle vehicle. 14.4.2 Be certified by a duly licensed medical practitioner as medically qualified and free of medical or physical conditions, which, absent reasonable accommodation, would limit safe operation of a shuttle vehicle. The physical examination shall be conducted prior to employment and periodically thereafter. 14.4.3 Possess a satisfactory driving record and criminal history record, after review of such records prior to employment and periodically thereafter to the extent permitted or available by law. 14.4.4 Prior to employment and from time-to-time thereafter, to the extent permitted by law, undergo such tests as may reveal, within a reasonable degree of medical or scientific certainty, the presence or absence of drugs or controlled substances in the body and such tests as may clinically reveal alcoholism or alcohol abuse. Negative findings for such tests shall be a condition of employment. 14.4.5 Meet any other criteria required by law or by Prodigy’s policies, rules or regulations.

  • Business and Travel Expenses Company shall pay or reimburse Executive for all reasonable, customary and necessary business expenses (including cell phone, travel, lodging, and entertainment expenses) which are correctly documented and incurred or paid by Executive in the performance of Executive’s duties and responsibilities hereunder, subject to the rules, regulations, and procedures of Company and in effect from time to time.

  • Safe Operations Notwithstanding any other provision of this Agreement, an NTO may take, or cause to be taken, such action with respect to the operation of its facilities as it deems necessary to maintain Safe Operations. To ensure Safe Operations, the local operating rules of the ITO(s) shall govern the connection and disconnection of generation with NTO transmission facilities. Safe Operations include the application and enforcement of rules, procedures and protocols that are intended to ensure the safety of personnel operating or performing work or tests on transmission facilities.

  • PERSONNEL FOLDERS ‌ An employee shall be entitled to review the contents of the employee’s official departmental personnel folder at reasonable intervals, upon request, during hours when the employee’s personnel office is normally open for business. Such review shall not interfere with the normal business of the department. No disciplinary document shall be placed in an employee’s official departmental personnel folder without providing said employee with a copy thereof.
