Option Not Exercised. If the other Member does not give such notice within the 30 days period set forth in Section 9.3, neither such Member nor the Company shall have any interest in the acquired interest and the acquired interest shall not be part of the Properties or the Mining Rights or otherwise be subject to this Agreement.
