Order of Benefit Determination Rules. When a Member is covered by two (2) or more Contracts, the rules for determining the order of benefit payments are as follows: 1. The Primary Contract pays or provides its benefits according to its terms of coverage and without regard to the benefits of any other Contract. 2. a) Except as provided in Paragraph 2.b) below, a Contract that does not contain a coordination of benefits provision that is consistent with this regulation is always primary unless the provisions of both Contracts state that the complying Contract is primary.
