Common use of Order of Lay-off Clause in Contracts

Order of Lay-off. Where lay-off is required, the order of lay-off shall be by reverse seniority as follows: 1) term employees, in reverse order of seniority; then 2) probationary employees, in reverse order of seniority; and then 3) permanent employees, in reverse order of seniority. In order to exercise seniority rights, employees must be qualified to perform the functions of the remaining position(s) which is most nearly equivalent to their former positions.
