Order to Suspend. (a) Company may, at its sole option, upon not less than seven (7) days’ prior written notice to Contractor, suspend at any time the performance of all or any portions of the Work, including delivery of a component of the Work or erection of any portion of the Work that has been delivered to the Site. Such notice shall specify the length of time that Company anticipates the Work shall be suspended. (b) If the Work is suspended for a period of more than one hundred and eighty (180) days pursuant to notice given under Section 16.1(a), Contractor may terminate this Contract by thirty (30) days’ written notice to Company unless the suspension is lifted within such thirty (30) day period. Any such termination shall be treated as a Voluntary Termination by Company as set forth in Section 29.1(b). (c) In the event of such suspension, Contractor shall, unless the notice requires otherwise: (i) Discontinue the Work on the date and to the extent specified in the notice; (ii) Place no further orders or subcontracts for Equipment, Materials or services with respect to the suspended Work, other than to the extent required in the notice; and (iii) Promptly make every reasonable effort to obtain suspension, upon terms reasonably satisfactory to Company, of all orders, subcontracts and rental agreements to the extent they relate to performance of the Work suspended. (d) Unless otherwise instructed by Company in writing, Contractor shall during any suspension affecting the progress of the Work on Site, maintain its staff, labor and Equipment and Materials on or near the Site ready to proceed with the Work upon receipt of the further instructions of Company. (e) If Company desires to extend the period of suspension for a longer time than that specified in the original notice given by Company, Company shall so notify Contractor in writing and the same procedures described in Article 10 shall be followed to determine whether to extend the suspension and the amount of the Costs which shall be incurred as a result of any such extension, and any such extension shall be effected via a Change Order as a Company-Proposed Change.
