Common use of Ordinary Working Hours Clause in Contracts

Ordinary Working Hours. 14.1 The ordinary hours of work of full-time Employees will be an average of 38 per week over a 52 week period, to be worked on up to five days (which need not be consecutive) in any week on the basis of 152 ordinary hours in any 28 consecutive days. 14.2 The ordinary hours of work will not exceed twelve hours in any day. 14.3 The commencing times of any Employee’s daily ordinary hours of work may vary from day to day in the week. 14.4 The ordinary hours of work are to be worked continuously, except for meal and rest breaks, at the discretion of the Company between 6.00am and 6.00pm. 14.5 The arrangement of ordinary hours of work will be reviewed on a regular basis by the Company's warehouse management personnel to ensure that customer demands are being met. 14.6 The spread of ordinary hours, the start and finish times of Employees' ordinary hours and/or the days on which ordinary hours will be performed may be altered by mutual agreement between the Company and the majority of affected Employees, or with an affected individual Employee, or in the absence of agreement, by seven days' notice of alteration given by the Company to the affected Employee(s). 14.7 Where the spread of ordinary hours, the start and finish time of an Employee’s ordinary hours and/or the days on which ordinary hours are performed is altered in accordance with this clause, work done within the altered spread of hours, start and finish times of the Employee’s ordinary hours and/or days is not to be treated as overtime and will be paid at the Employee's ordinary hourly rate. 14.8 Employees must clock on and be ready to start work at their official starting time. 14.9 The Company will continue to use a multiple crew operation, with each crew having different starting and finishing times. The Company will give Employees seven days' notice prior to the implementation of a change to this arrangement. 14.10 Employees will rotate between the crews as required by the Company. The Company may elect to revert to a one crew operation in the future.

However, if hours worked do exceed 152 in a period of 28 consecutive days by reason only of the fact that a rostered day off does not fall within that 28 day period, to such excess hours will be worked on up to five days (which need not be consecutive) in any week on the basis of 152 treated as ordinary hours in any 28 consecutive daysfor all purposes. 14.2 The Employees' ordinary hours of work will not exceed twelve hours in any day. 14.3 The commencing times of any Employee’s daily ordinary hours of work may vary from day to day in the week. 14.4 The ordinary hours of work are to be worked continuously, except for meal and rest breaks, at the discretion of the Company as follows: (a) whilst not required to rotate between day, afternoon and/or night shift, between 6.00am and 6.00pm6.00pm on any five consecutive days of the week, Monday to Sunday inclusive; and (b) whilst required to rotate between day, afternoon and/or night shift, at any time on any day of the week, Monday to Sunday inclusive; and (c) When engaged on day work, either as a day worker or rotating shift worker, the penalty rate of double the ordinary rate shall apply for ordinary hours worked prior to 6.00 am Monday to Friday 14.3 The ordinary hours of work for an Employee will not exceed twelve hours in any day and/or shift. 14.4 In this Agreement: (a) Afternoon Shift means any shift finishing after 6.00pm and at or before midnight; (b) Day shift means any shift commencing at or after 5.00am and finishing at or before 6:00pm; (c) Night Shift means any shift finishing after midnight and at or before 8.00am. 14.5 The arrangement Company may alter working arrangements on a temporary or permanent basis in order to meet the operational requirements of ordinary hours of the business, including (but not limited to): (a) the days when work will be reviewed on a regular basis by performed; (b) the Company's warehouse management personnel to ensure shifts that customer demands are being met.will be worked; and 14.6 The spread of ordinary hours, (c) the start starting and finish finishing times of Employees' ordinary hours and/or shifts, after consultation with the days on which ordinary hours will be performed may be altered by mutual agreement between the Company Employee(s) affected and the majority of affected Employees, or with an affected individual Employee, or in the absence of agreement, by seven days' notice of alteration given by the Company to the Employees, or earlier if by agreement with the majority of affected Employee(s)Employees. 14.6 Employees are required to work their ordinary hours in accordance with the roster. The roster may require an Employee to: (a) rotate between day, afternoon and/or night shift; (b) work out of rotation on a particular shift, either on a temporary or permanent basis. 14.7 Where the spread Whilst on afternoon or night shift, an Employee will be paid a shift allowance of ordinary hours, the start and finish time of an Employee’s ordinary hours and/or the days on which ordinary hours are performed is altered in accordance with this clause, work done within the altered spread of hours, start and finish times 15 per cent of the Employee’s ordinary hours and/or days is All Purpose Rate. This extra allowance will not apply to be treated as overtime and shift work performed where penalty rates apply in accordance with clause 17 of this Agreement. 14.8 Whilst on permanent night shift an Employee will be paid at a shift allowance of 30 per cent of the Employee's ordinary hourly rate. 14.8 Employees must clock on and be ready All Purpose Rate.
