OTHER CONDITIONS AND SERVICES. 14.1 Unless the Owner and the Design/Builder mutually agree to begin a sub-set of the work prior to the Owner's approval of Part 1-B, the Design/Builder will begin the Basic Services to be performed under Part 2 upon the Owner’s approval of Part 1-B. Substantial Completion, subject to authorized adjustments and to delays beyond the control of the Design/Builder, shall be achieved by 00/00/0000. 14.2 (Applicable only if checked ) SHOULD THE DESIGN/BUILDER FAIL TO ACHIEVE SUBSTANTIAL COMPLETION WITHIN THE NUMBER OF DAYS ALLOTTED FOR COMPLETION OF PART 2, the DESIGN/BUILDER shall incur damages. Damages will be charged as actual, documented expenses incurred by the University for not possessing the functional space, but not to exceed ($ ) dollars for the entire contract term. Prior to the attachment of damages, the Owner will give the Design/Builder a ten (10) day written notice, that the Owner claims that damages have been incurred. 14.3 The Design/Builder shall submit an Application for Payment on the 1st day of each month. 14.4 (Applicable only if checked ) The Design/Builder’s Proposal includes the following documents:
