Other Types of Traffic. 8.1 Notwithstanding any other provision of this Agreement or any Tariff: (a) the Parties’ rights and obligations with respect to any intercarrier compensation that may be due in connection with their exchange of Internet Traffic shall be governed by the terms of the FCC Internet Orders and other applicable FCC orders and FCC Regulations; and, (b) a Party shall not be obligated to pay any intercarrier compensation for Internet Traffic that is in excess of the intercarrier compensation for Internet Traffic that such Party is required to pay under the FCC Internet Orders and other applicable FCC orders and FCC Regulations. 8.1.1 For the avoidance of doubt, VOIP Traffic exchanged pursuant to this Agreement will be governed by the default provisions of USF/ICC Transformation Order FCC 11-161 (rel. November 18, 2011) as such order may be revised, reconsidered, modified or changed in the future. When such revisions, reconsiderations, modifications or changes are effective, such provisions shall be automatically incorporated into this Agreement. For clarity, and subject to any future revisions, reconsiderations, modifications or changes in the USF/ICC Transformation Order, interexchange VoIP traffic terminated to either Party is subject to access charges based on the appropriate access tariff, and local VoIP traffic terminated to either Party is subject to the reciprocal compensation provisions of this Agreement. The Parties agree access charges will comply with all FCC mirroring and default phase-down requirements 8.2 Subject to Section 8.1 of this Attachment, interstate and intrastate Exchange Access, Information Access, exchange services for Exchange Access or Information Access, and InterMTA Traffic shall be governed by the applicable provisions of this Agreement and applicable Tariffs. 8.3 For any traffic originating with a third-party carrier and delivered by DISH Wireless to Frontier, DISH Wireless shall pay Frontier the same amount that such third-party carrier would have been obligated to pay Frontier for termination of that traffic at the location the traffic is delivered to Frontier by DISH Wireless. 8.4 Any traffic not specifically addressed in this Agreement shall be treated as required by the applicable Tariff of the Party transporting and/or terminating the traffic. 8.5 The Parties may also exchange Internet Traffic at the technically feasible Point(s) of Interconnection on Frontier’s network in a LATA established hereunder for the exchange of Reciprocal Compensation Traffic. Any intercarrier compensation that may be due in connection with the Parties’ exchange of Internet Traffic shall be applied at such technically feasible Point of Interconnection on Frontier’s network in a LATA in accordance with the FCC Internet Orders and other applicable FCC orders and FCC Regulations.

Other Types of Traffic. 8.1 Notwithstanding any other provision of this Agreement or any Tariff: (a) the Parties’ rights and obligations with respect to any intercarrier compensation that may be due in connection with their exchange of Internet ISP-bound Traffic shall be governed by the terms of the FCC Internet Orders Order and other applicable FCC orders and FCC Regulations; and, and (b) a Party shall not be obligated the Parties’ rights and obligations with respect to pay any intercarrier compensation for that may be due in connection with their exchange of Internet Traffic that other than ISP-bound Traffic shall be governed by Applicable Law. If the FCC Internet Order or any other FCC order or FCC Regulation, or any FCC established intercarrier compensation rate, applicable to ISP-bound Traffic or Internet Traffic is vacated, reversed, revised, modified, or amended, by a court of competent jurisdiction or the FCC, the Parties shall promptly renegotiate in excess good faith and amend in writing this Agreement in accordance with Section 4 (“Applicable Law”) of the intercarrier compensation for Internet Traffic General Terms and Conditions to conform the Agreement to Applicable Law. If the Parties cannot agree within thirty (30) days of the effective date of such decision or order by a court of competent jurisdiction or the FCC on the amendment, if any, that such Party is required to pay under conform the FCC Internet Orders and other applicable FCC orders and FCC Regulations. 8.1.1 For the avoidance of doubt, VOIP Traffic exchanged Agreement to Applicable Law pursuant to this Agreement will be governed by Section 8.1, either Party may submit the default provisions disagreement to the Commission or to another governmental body of USF/ICC Transformation Order FCC 11-161 (rel. November 18, 2011) as applicable jurisdiction and the decision resolving such order may be revised, reconsidered, modified or changed in the future. When such revisions, reconsiderations, modifications or changes are effective, such provisions dispute shall be automatically incorporated into this Agreement. Any intercarrier compensation that may be due in connection with the Parties’ exchange of Internet Traffic shall be applied at such technically feasible Point of Interconnection on Frontier’s network in a LATA in accordance with the FCC Internet Orders and other applicable FCC orders and FCC Regulations.

If the FCC Internet Order or any other FCC order or FCC Regulation, or any FCC established intercarrier compensation rate, applicable to ISP-bound Traffic or Internet Traffic is vacated, reversed, revised, modified, or amended, by a court of competent jurisdiction or the FCC, the Parties shall promptly renegotiate in excess good faith and amend in writing this Agreement in accordance with Section 4 (“Applicable Law”) of the intercarrier compensation for Internet Traffic General Terms and Conditions to conform the Agreement to Applicable Law. Any intercarrier compensation that may be due in connection with the Parties’ exchange of Internet Traffic shall be applied at such technically feasible Point of Interconnection on Frontier’s Inter network in a LATA in accordance with the FCC Internet Orders and other applicable FCC orders and FCC Regulations.

The Parties agree access charges will comply with all FCC mirroring and default phase-down requirements 8.2 Subject to Section 8.1 of this Attachment, interstate and intrastate Exchange Access, Information Access, exchange services for Exchange Access or Information Access, and InterMTA Traffic shall be governed by the applicable provisions of this Agreement and applicable Tariffs. 8.3 For any traffic originating with a third-party carrier and delivered by DISH Wireless to Frontier, DISH Wireless shall pay Frontier the same amount that such third-party carrier would have been obligated to pay Frontier for termination of that traffic at the location the traffic is delivered to Frontier by DISH Wireless. 8.4 Any traffic not specifically addressed in this Agreement shall be treated as required by the applicable Tariff of the Party transporting and/or terminating the traffic. 8.5 The Parties may also exchange Internet Traffic at the technically feasible Point(s) of Interconnection on Frontier’s network in a LATA established hereunder for the exchange of Reciprocal Compensation Traffic. Any intercarrier compensation that may be due in connection with the Parties’ exchange of Internet Traffic shall be applied at such technically feasible Point of Interconnection on Frontier’s network in a LATA in accordance with the FCC Internet Orders and other applicable FCC orders and FCC Regulations.

Any intercarrier compensation that may be due in connection with the Parties’ exchange of Internet Traffic shall be applied at such technically feasible Point of Interconnection on Frontier’s network in a LATA in accordance with the FCC Internet Orders and other applicable FCC orders and FCC Regulations.

Other Types of Traffic. 8.1 Notwithstanding any other provision of this Agreement or any Tariff: (a) the Parties’ rights and obligations with respect to any intercarrier compensation that may be due in connection with their exchange of Internet ISP-bound Traffic shall be governed by the terms of the FCC Internet Orders Order and other applicable FCC orders and FCC Regulations; and, and (b) a Party shall not be obligated the Parties’ rights and obligations with respect to pay any intercarrier compensation for that may be due in connection with their exchange of Internet Traffic that other than ISP-bound Traffic shall be governed by Applicable Law. If the FCC Internet Order or any other FCC order or FCC Regulation, or any FCC established intercarrier compensation rate, applicable to ISP-bound Traffic or Internet Traffic is vacated, reversed, revised, modified, or amended, by a court of competent jurisdiction or the FCC, the Parties shall promptly renegotiate in excess good faith and amend in writing this Agreement in accordance with Section 4 (“Applicable Law”) of the intercarrier compensation for Internet Traffic General Terms and Conditions to conform the Agreement to Applicable Law. If the Parties cannot agree within thirty (30) days of the effective date of such decision or order by a court of competent jurisdiction or the FCC on the amendment, if any, that such Party is required to pay under conform the FCC Internet Orders and other applicable FCC orders and FCC Regulations. 8.1.1 For the avoidance of doubt, VOIP Traffic exchanged Agreement to Applicable Law pursuant to this Agreement will be governed by Section 8.1, either Party may submit the default provisions disagreement to the Commission or to another governmental body of USF/ICC Transformation Order FCC 11-161 (rel. November 18, 2011) as applicable jurisdiction and the decision resolving such order may be revised, reconsidered, modified or changed in the future. When such revisions, reconsiderations, modifications or changes are effective, such provisions dispute shall be automatically incorporated into this Agreement. For clarity, and subject to any future revisions, reconsiderations, modifications or changes in the USF/ICC Transformation Order, interexchange VoIP traffic terminated to either Party is subject to access charges based on the appropriate access tariff, and local VoIP traffic terminated to either Party is subject effective retroactive to the reciprocal compensation provisions effective date of this Agreement. The Parties agree access charges will comply with all FCC mirroring and default phase-down requirementssuch decision or order by a court of competent jurisdiction or the FCC. 8.2 Subject to Section 8.1 of this Attachmentabove, interstate and intrastate Exchange Access, Information Access, exchange services for Exchange Access or Information Access, and InterMTA Traffic Toll Traffic, shall be governed by the applicable provisions of this Agreement and applicable Tariffs. 8.3 For any traffic originating with a third-third party carrier and delivered by DISH Wireless ICG to FrontierVerizon, DISH Wireless ICG shall pay Frontier Verizon the same amount that such third-third party carrier would have been obligated to pay Frontier Verizon for termination of that traffic at the location the traffic is delivered to Frontier Verizon by DISH WirelessICG. 8.4 Any traffic not specifically addressed in this Agreement shall be treated as required by the applicable Tariff of the Party transporting and/or terminating the traffic. 8.5 The Parties may also exchange Internet Traffic at the technically feasible Point(s) of Interconnection on Frontier’s network in a LATA established hereunder for the exchange of Reciprocal Compensation Traffic. Any intercarrier compensation that may be due in connection with the Parties’ exchange of Internet Traffic shall be applied at such technically feasible Point of Interconnection on Frontier’s network in a LATA in accordance with the FCC Internet Orders and other applicable FCC orders and FCC Regulations.traffic.‌‌‌‌‌‌‌‌‌‌‌‌

For clarity, and subject to any future revisions, reconsiderations, modifications or changes in the USF/ICC Transformation Order, interexchange VoIP traffic terminated to either Party is subject to access charges based on the appropriate access tariff, and local VoIP traffic terminated to either Party is subject to the reciprocal compensation provisions of this Agreement. Any intercarrier compensation that may be due in connection with the Parties’ exchange of Internet Traffic shall be applied at such technically feasible Point of Interconnection on Frontier’s network in a LATA in accordance with the FCC Internet Orders and other applicable FCC orders and FCC Regulations.

November 18, 2011) as such order may be revised, reconsidered, modified or changed in the future. When such revisions, reconsiderations, modifications or changes are effective, such provisions shall be automatically incorporated into this Agreement. For clarity, and subject to any future revisions, reconsiderations, modifications or changes in the USF/ICC Transformation Order, interexchange VoIP traffic terminated to either Party is subject to access charges based on the appropriate access tariff, and local VoIP traffic terminated to either Party is subject to the reciprocal compensation provisions of this Agreement. The Parties agree access charges will comply with all FCC mirroring that Local Traffic to either Party's paging carrier customers which is reasonably identifiable through use of specific trunk groups, switches or other means, shall not be included in determining the 3:1 ratio of terminating to originating traffic described in Paragraphs 8 and default phase-down requirements 8.2 79 of the FCC's Internet Order. Subject to Section 8.1 of this Attachment9.1 above, interstate and intrastate Exchange Access, Information Access, exchange services for Exchange Access or Information Access, and InterMTA Traffic Toll Traffic, shall be governed by the applicable provisions of this Agreement and applicable Tariffs. 8.3 For any traffic originating with a third-party carrier and delivered by DISH Wireless to Frontier, DISH Wireless shall pay Frontier the same amount that such third-party carrier would have been obligated to pay Frontier for termination of that traffic at the location the traffic is delivered to Frontier by DISH Wireless. 8.4 . Any traffic not specifically addressed in this Agreement shall be treated as required by the applicable Tariff of the Party transporting and/or terminating the traffic. If one Party is passing CPN but the other Party is not properly receiving the CPN information, the Party passing the CPN will use best efforts on the receiving Party's behalf to correct the problem. Pac-West and Verizon agree to exchange such reports and/or data as necessary to facilitate the proper billing of traffic. Where either Party is performing a transiting function, the transiting Party will include the original and true CPN and Originating Carrier Number ("OCN") as part of the call records provided to the receiving Party if it is received from the originating third party. 8.5 The Parties may also exchange Internet Traffic at the technically feasible Point(s) of Interconnection on Frontier’s network in a LATA established hereunder for the exchange of Reciprocal Compensation Traffic. Any intercarrier compensation that may be due in connection with the Parties’ exchange of Internet Traffic shall be applied at such technically feasible Point of Interconnection on Frontier’s network in a LATA in accordance with the FCC Internet Orders and other applicable FCC orders and FCC Regulations.
