Otherwise Eligible Sample Clauses

The "Otherwise Eligible" clause defines the conditions under which a party or individual may qualify for a benefit, right, or status, provided they meet all other requirements except for a specific exception addressed elsewhere in the agreement. In practice, this clause is often used to clarify that someone who would normally qualify for a program, payment, or opportunity—if not for a particular disqualifying factor—may still be considered eligible if that factor is waived or addressed. Its core function is to ensure fairness and flexibility by allowing exceptions to standard eligibility rules, thereby preventing unintended exclusions.
Otherwise Eligible. Enrollment shall be restricted to only those occasions provided for in this Article 6 unless an individual is eligible for Enrollment under the HIPAA provisions allowing special enrollment rights. Enrollment shall be in accordance with HIPAA and PPACA requirements.
