Overpayments; Underpayments. CONTRACTOR shall provide written notice to the Orange County ▇▇▇▇▇▇ Care 2 Eligibility unit immediately, and no later than within thirty (30) days of receipt of a 3 4 payment for an Orange County placement which is inconsistent with the actual period 5 of placement and results in an overpayment or underpayment. The overpayment or 6 7 underpayment shall be identified by the ▇▇▇▇▇▇ Youth/NMD's name, case number, 8 caseload number, and the amount of overpayment or underpayment. 9 10 Any payment(s) made by COUNTY to CONTRACTOR in excess of that to which 11 CONTRACTOR is entitled under this Agreement shall be repaid to COUNTY, in 12 13 accordance with any applicable regulations and/or policies in effect during the term 14 of this Agreement, or as established by COUNTY procedure. Any overpayments 15 16 made by COUNTY which result from a payment by any other funding source shall 17 be repaid, at the discretion of ADMINISTRATOR, to COUNTY or the funding 18 19 source. Unless earlier repaid, CONTRACTOR shall make repayment within thirty 20 (30) days after the date of the final audit findings report and prior to any 21 22 administrative appeal process. In the event an overpayment owing by 23 CONTRACTOR is collected from COUNTY by the funding source, then 24 25 CONTRACTOR shall reimburse COUNTY within thirty (30) days thereafter and 26 prior to any administrative appeal process. CONTRACTOR agrees to pay all costs 27 28 incurred by COUNTY necessary to enforce the provisions set forth in this Paragraph.
