Owner Default Sample Clauses

The "Owner Default" clause defines the circumstances under which the owner of a project or property is considered to be in breach of their contractual obligations. Typically, this clause outlines specific actions or failures—such as not making required payments, failing to provide necessary approvals, or not fulfilling other agreed-upon responsibilities—that would constitute a default by the owner. In practice, it may also describe the process for notifying the owner of the default and the remedies available to the other party, such as suspending work or seeking damages. The core function of this clause is to clearly allocate risk and establish procedures for addressing owner-related breaches, thereby protecting the interests of the contractor or service provider.
