OWNER DESIGNEE. If Owner consists of more than one individual, corporation, limited liability company or partnership, or any combination thereof, then (a) each individual and entity comprising Owner is jointly and severally liable with all other individuals and entities comprising Owner for all obligations and liabilities of “Owner” under this Agreement, and (b) the person designated on the signature page to this Agreement as the “Owner designee” is authorized by Owner (and all individuals and entities comprising Owner) to act exclusively on behalf of Owner (and all individuals and entities comprising Owner) with respect to all matters which are the subject of this Agreement, and any action taken by the Owner designee shall be binding upon Owner (and all individuals and entities comprising Owner), and Manager shall be entitled to rely upon any action taken by such Owner designee as being the act of Owner (and all individuals and entities comprising Owner). The Owner designee may be changed by written notice executed by Owner (and all individuals and entities comprising Owner) and delivered to Manager pursuant to this Agreement.
OWNER DESIGNEE. The parties acknowledge that the Owner has authorized the Superintendent or designee to enter into service contracts involving expenditures of up to $100,000. The parties further acknowledge that the Owner may perform all or part of its obligations pursuant to this Agreement through the Superintendent or designee.

  • Owner’s Designated Representative Prior to the start of construction, Owner will identify the Owner’s Designated Representative (ODR), who has the express authority to act and bind the Owner to the extent and for the purposes described in the Contract, including responsibilities for general administration of the Contract. 3.1.2.1 Unless otherwise specifically defined elsewhere in the Contract Documents, the ODR is the single point of contact between the Owner and Contractor.
