Common use of Parks and Open Space Clause in Contracts

Parks and Open Space. Recognizing the benefits of public open space including both passive and active spaces, Developer has agreed to allocate 19.10 acres or 40.55% of the Property as a conservation area which will be provided through the following elements. a) Open space and trail system. Developer will preserve open space and construct the trail system as depicted in the Master Plan. A standard maintenance agreement obligating the owner or property owners association must be executed prior to approval of preliminary site and civil design plans.
