Participant or the Employer Clause Samples

The 'Participant or the Employer' clause defines the parties to whom certain rights, obligations, or benefits under the agreement may apply, specifically distinguishing between the individual participant and their employer. In practice, this clause clarifies whether actions, notifications, or entitlements are to be directed to the employee (participant) or the employing organization, depending on the context of the agreement. Its core function is to ensure clarity in the allocation of responsibilities and benefits, thereby preventing misunderstandings about which party is affected by or responsible for specific provisions.
Participant or the Employer. If the Partnership offers the Participant a grant of DRUs under the Plan, then the Partnership will collect the Participant’s personal data for purposes of allocating stock and implementing, administering and managing the Plan. The Partnership’s legal basis for the processing of the Participant’s personal data would be his or her consent.
