Participation at own risk. Consistent with the principle articulated at Article Articles 23.1 and 23.2, a Competitor has sole discretion to determine whether or not it is safe to test, train, sail, and/or race on any given day. Therefore, each Competitor, for itself and on behalf of its Team Members, also expressly understands and agrees that in taking part in the whole or any part of AC35 it does so at its own risk and responsibility and further agrees to the detailed exculpation and indemnity provisions in Article 23.4.
