Participation Goals. The Contractor represents that it has reviewed and familiarized itself with the regulations related to Article 15-A found at 5 NYCRR Parts 140-144 (see ▇▇▇▇://▇▇▇.▇▇▇▇▇▇.▇▇▇▇▇.▇▇.▇▇/MWBE/Data/122210_MWBE15-ARegs.pdf), which regulations (the “Regulations”) are hereby incorporated herein by this reference. Any conflicts between this Agreement and the Regulations shall be resolved in favor of the Regulations. Contractor shall, in accordance with the Regulations, make good faith efforts and, in a manner that can be established in documentary form, solicit active participation by certified MWBE businesses as identified in the applicable state directory maintained by the NYS Empire State Development’s Division of Minority and Women Business Development (see ▇▇▇▇▇://▇▇.▇▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇/). Additionally, Contractor is encouraged to contact the Division of Minority and Woman Business Development ((▇▇▇) ▇▇▇-▇▇▇▇; (▇▇▇) ▇▇▇-▇▇▇▇; or (716) 846- 8200) to discuss additional methods of maximizing participation by MWBEs on the Contract. In furtherance, thereof, the Contractor has submitted the following information to NYSERDA, which information sets forth NYSERDA’s and Contractor’s agreed upon participation goals during the performance of this Agreement: (a) A completed MWBE Utilization Plan Form (see Attachment 2) and/or a NYSERDA- approved Waiver Form (see Attachment 6); and (b) A staffing plan of the anticipated workforce to be utilized by the Contractor during this Agreement, or in the case where the workforce to be utilized in the performance of this Agreement cannot be separated out from the Contractor's and/or its subcontractor workforce, information on the Contractor's and/or subcontractor's total workforce. The staffing plan or workforce data, as applicable, is broken down by ethnic background, gender and Federal occupational categories, or other appropriate categories specified by NYSERDA (see Attachment 3).
Participation Goals. The following goals and conditions apply to this contract and submissions of a proposal by prospective Contractor shall constitute full acceptance of all conditions outlined in the Construction Manager Selection Booklet documents or submittals. The attainment of MBE participation goals established for this contract will be measured as a percentage of the GMP stated in the contract. The goals established for this contract are: 10% SBE and 10% M/WBE. Only companies that are certified as African American or Hispanic American can be used towards achieving the M/WBE goal on this contract.

In furtherance thereof, the Contractor has submitted a completed SDVOB Utilization Plan (see Attachment 8) and/or a NYSERDA approved Waiver Form (see Attachment 10), which information sets forth NYSERDA’s and Contractor’s agreed upon participation goals during the performance of this Agreement.
Participation Goals. The goals and conditions as specified in the Request for Qualifications (RFQ) shall apply to this contract.
Participation Goals. The minority-business enterprise (“MBE”) and women-business enterprise (“WBE”) participation goals (“Participation Goals”) for the Agreement are set forth in this Section 1 and shall be read in conjunction with ARTICLE 6 of the Agreement and Section 34 of the NYCHA General Terms and Conditions. These Participation Goals are a percentage of the total dollar value of the Agreement (“Maximum Fee” or “Not-to-Exceed Amount”), or as same may be amended from time-to-time. The Consultant shall achieve the Participation Goals by awarding subcontracts to firms certified with the New York City Department of Small Businesses (“SBS”) as MBEs and/or WBEs (collectively, “M/WBEs”), and/or by crediting the participation of the Consultant itself toward the Participation Goals if Consultant is a SBS certified MBE, WBE or M/WBE (or qualified joint venture as provided in Section 3 below), unless the Participation Goals have been waived or modified by NYCHA in accordance with Part A, Sections 8 and 9 below, respectively. M/WMBEs (including Consultant itself) must be certified by SBS in order for the Consultant to credit such firms’ participation toward the Participation Goals. All references to MBEs, WBEs, and M/WBEs in this Exhibit shall mean those firms certified by the SBS unless otherwise indicated. The Agreement’s Participation Goals are as follows:

  • Program Participation By participating in the CRF Program, Grantee agrees to: a. Not increase any Eligible Household’s rent through January 2021; b. Waive all costs, fees and charges incurred by Eligible Households as a result of non- payment or partial payment of rent during the impacted months; c. Not consider non-payment or partial payment by Eligible Households during impacted months when considering renewal of an Eligible Household’s lease, or, share this information with other rental properties, credit bureaus and tenant screening companies; d. Not initiate new Eligible Household evictions for non-payment of rent and must suspend all pending evictions of Eligible Households for nonpayment of rent for the duration of the rental payment assistance; e. Not issue a notice to vacate to Eligible Households for nonpayment of rent until the end of the Eviction Relief Period; and f. Not require Eligible Households to vacate the unit until 30 days after such notice.

  • Committee Participation 9.01 Except as otherwise provided in this Collective Agreement, an Employee (or the Employee’s alternate) who is a member and attends meetings of a committee established by the Employer, shall be paid at the Employee’s Basic Rate of Pay for attendance at such meetings. Such participation shall be voluntary.
