Parties’ Submissions after Period II Verification. After the External Monitor’s Period II Monitoring Report to the Court, the Parties will have 30 days, or until a date agreed to by the Parties, to make submissions to the Court about whether the External Monitor’s role should remain unchanged, increase, or decrease with respect to the DOE. Upon review of the External Monitor’s report and recommendations following Period II Verification and the Parties’ submissions, if applicable, the Court will determine whether the External Monitor’s role should remain unchanged, decrease, or increase with respect to the DOE based upon findings as to the DOE’s substantial compliance. Replies will be due 15 days later.
