PASSAGE OF THE RISK – PASSAGE OF THE OWNERSHIP. 5.1. Passage of the risk 5.1.1. Unless otherwise agreed between the Parties, the risks will pass to the Buyer at the arrival of the Products in the place agreed upon for the delivery and from the moment in which the Buyer should take over the Products delivered pursuant to the applicable Incoterm 2010. 5.1.2. The Seller shall not be liable in any case for deterioration of or damages to the Products which have occurred after the passage of risks. The Buyer is not released from any obligation to pay the Price if the deterioration or damages to the Products occurs after the passage of the risks.
