Common use of PASSENGERS Clause in Contracts

PASSENGERS. In some cases THE CARRIER may limit its liability if it proves that: (a) The damage was not caused by negligence or any other wrongful act or omission by THE CARRIER, its employees or agents. (b) The damage was solely caused by the negligence or any other wrongful act or omission by a third party. THE CARRIER shall not be liable for a Passenger’s sickness not caused by acts attributable to THE CARRIER.

(c) Damages resulted solely from Passenger’s negligence or from pre-existing injuries or sickness and have not been worsened byacts attributable to THE CARRIER.
