Common use of PASSENGERS Clause in Contracts

PASSENGERS. THE CARRIER shall not be able to exclude or limit its liability if damages as described in paragraph 15.3.3.1 do not exceed 128, 821 Special Drawing Rights per Passenger. THE CARRIER shall not be liable for damages described in paragraph 15.3.3.1 exceeding the amount of 128, 821 Special Drawing Rights per Passenger if it proves that: 1) Damages were not caused by the negligence or any other wrongful action or omission of THE CARRIER, its employees or agents, or 2) Damages were solely caused by the negligence or any other wrongful action or omission of a third party.
