Common use of Payment of the Aggregate Exercise Price Clause in Contracts

Payment of the Aggregate Exercise Price. Payment of the Aggregate Exercise Price shall be made to the Company in cash or other immediately available funds or as provided in Section 2(c), or a combination thereof. In the case of payment of all or a portion of the Aggregate Exercise Price pursuant to Section 2(c), the direction by the Holder to make a “Cashless Exercise” shall serve as accompanying payment for that portion of the Exercise Price.

Payment of the Aggregate Exercise Price. Payment of the Aggregate Exercise Price shall be made by delivery to the Company in cash of a certified or other official bank check payable to the order of the Company or by wire transfer of immediately available funds or as provided to an account designated in Section 2(c), or a combination thereof. In the case of payment of all or a portion of the Aggregate Exercise Price pursuant to Section 2(c), the direction writing by the Holder to make a “Cashless Exercise” shall serve as accompanying payment for that portion Company, in the amount of the such Aggregate Exercise Price.
