Upon NIGC Approval and transfer of the Gaming Site into trust eligible for Gaming purposes, Great Lakes will pay the Band a non-refundable fee of $1,000,000 (the "Scholarship Program Fee") into an account established and controlled by the Band. The ultimate use and disbursement of these funds shall be at the sole discretion of the Band, and Great Lakes shall have no responsibility for such funds after payment to the Band.
