Deductions for other pro- grams may be filed by BTU-ESP with the Payroll Department. Employees who desire to become members of the BTU-ESP shall file their authorization form with the BTU-ESP. Pursuant to such authorization, the Board shall deduct such annual sum as authorized in equal payments according to a schedule mutually agreed to by the parties parties. 2. The State agrees to deduct FOP/MSLES membership dues and insurance premiums from the pay of those employees regular salary check, beginning with the first pay check who individually request in the pay period following date writing that such deductions be made. New employees eligible upon completion of six (6) months service may also have such payroll deduction during their initial six (6) month period. The employee's written authorization for new memberspayroll deductions shall contain the employee's name, agency in which employed, and work location. Such authorization shall continue be transmitted by an authorized representative of FOP/MSLES or the employee to the State Controller through the applicable agency payroll clerk. When such authorization is transmitted directly from the employee to the agency payroll clerk, a copy of the authorization shall be sent to FOP/MSLES. 3. Employees who have already authorized such deductions shall not be required to submit new authorizations upon the execution of this Agreement. 4. A validly executed authorization for payroll deduction is an agreement between the employee and FOP/MSLES. The State agrees that is shall rely solely upon FOP/MSLES for notice of such authorizations or cancellations or changes thereto. 5. FOP/MSLES shall notify the State Controller, through the applicable agency payroll clerk, or any such authorizations, cancellations or changes thereto. 6. It may take up to four (4) weeks to process a validly executed authorization for payroll deduction or cancellations or changes thereto. 7. Any change in effect from month the amounts to month, thereafter unless revoked be deducted shall be certified to the Director of the Bureau of Human Resources by the employees in writing to the BTU-ESP and to the Payroll Department, not less than Treasurer of FOP/MSLES at least thirty (30) days prior to in advance of the next payroll cutoff datechange. During the life of this Agreement the Board agrees to deduct membership dues/fees from the pay of each employee who executes or who has executed the Dues/Fees Deduction Form and filed the same with the Board. The Board shall be entitled to rely solely on the written notice of the Association, as to the amount of dues/fees to be deducted from the employee=s wages and the employees from whom such deductions are to be made provided that the amount to be deducted shall be given to the Business Office at least three (3) weeks prior to the pay day on which deductions are to be made. Deductions for dues/fees shall not supersede any legally required deductions and the Board as shall not be required to make any check-off for dues/fees if the employee=s pay is not sufficient to cover the dues/fees in any pay period. 4. Deductions under all properly executed Dues/Fees Deduction Form shall become effective at the time the authorization is signed by the employee and shall be deducted from the first pay period of the month and each month thereafter unless and until the employee gives written notice of revocation for the deduction to the Board and the Association. 5. Payroll Deduction. 13.1. The Board shall, upon written authorization Company shall deduct Union membership fees (not including fines or levies) from the pay of any contract carrier provided that: (a) the contract carrier has authorised the Company to make such deductions in accordance with subclause (ii) herein; (b) the Union shall advise the Company of the employee, deduct BTU-ESP dues. The BTU-ESP shall furnish, distribute, and process authorization forms, said forms amount to be filed by BTU-ESP deducted for each pay period applying at the Company's workplace and any changes to that amount; and (c) deduction of union membership fees shall only occur in each pay period in which payment has or is to be made to a contract carrier. (d) The contract carrier’s authorisation shall be in writing and shall authorise the deduction of an amount of Union fees (including any variation in that fee affected in accordance with the Payroll DepartmentUnion rules) that the Union advises the Company to deduct. The deductions shall be remitted not less frequently than monthly to the BTU-ESPUnion on either a weekly, fortnightly, monthly or quarterly basis at the Company's election, together with all necessary information to enable the reconciliation and crediting of subscriptions to contract carriers' membership accounts, including, but not limited to, names, addresses, and phone numbers. (f) Where a list contract carrier has already authorised the deduction of members and the amount deducted year-to-date. The right Union membership fees in writing from his or her pay prior to such dues deduction this clause taking effect, nothing in this clause shall be granted exclusively read as requiring the contract carrier to make a fresh authorisation in order for such deductions to commence or continue. (g) The Union shall advise the BTU-ESP and shall not be granted Company of any change to any other employee organization seeking to represent employees in the bargaining unit. The BTU-ESP shall notify the Payroll Department of the amount of membership fees made under its rules, provided that this does not occur more than once in any change calendar year. Such advice shall be in annual dues the form of a schedule of fees to be deducted not later than specifying weekly, fortnightly, monthly, or quarterly as the last workday case may be. The Union shall give the Company a minimum of two months' notice of any such change. (h) A contract carrier may at any time revoke in writing an authorisation to the Company to make payroll deductions of Union membership fees. (i) Where a contract carrier who is a member of the month prior Union and who has authorised the Company to make payroll deductions of Union membership fees resigns his or her membership of the Union in accordance with the rules of the Union, the Union shall inform the contract carrier in writing of the need to revoke the authorisation to the month Company in which such change becomes effective. The BTU- ESP agrees order for payroll deductions of union membership fees to indemnify and hold harmless the Board, each individual Board Member and all administrators against any and all claims, costs, suits, or other forms of liability and all court costs arising out of the application of the provisions of this section. The Company remittance of the Union membership dues/service charges to the Union will be accompanied by a list showing names, payroll numbers and amounts deducted for Flight Attendants for whom deductions have been made in that particular period. The list shall be transmitted electronically, if possible. 4. No deduction of the Union dues/service charge will be made from the wages of any Flight Attendant who has executed a Dues/Service Charge Check Off Form and who has been transferred to a job not covered by this Agreement, who is on furlough, or who is on leave without pay check for a period longer than thirty (30) days. Upon return to work as a Flight Attendant covered by this Agreement, whether by transfer, termination of leave without pay, or recall from furlough, deductions shall be automatically resumed, provided the Flight Attendant has not revoked the assignment provisions of this Section and of the Railway Labor Act, as amended. 5. A Flight Attendant may revoke her/his Dues/Service Charge Check Off Form with thirty (30) days written notice of such revocation directed to the Director of Inflight. Such revocation will be valid notwithstanding any provisions to the contrary set forth in the pay period following date of authorization for new members. Such authorization shall continue in effect from month to month, thereafter unless revoked standard Dues/Service Charge Check Off Form provided by the employees in writing Union. 6. The Company shall only make the monthly dues/service charge deductions provided by the Union. Deductions of membership dues/service charge shall be made semi- monthly provided there is a balance in the paycheck sufficient to cover the amount after all other deductions authorized by the Flight Attendant or required by law have been satisfied.
