PCBs Sample Clauses
The 'PCBs' clause addresses the management and regulation of polychlorinated biphenyls (PCBs) within the context of a contract or agreement. It typically outlines the responsibilities of parties regarding the identification, handling, removal, and disposal of materials or equipment containing PCBs, which are hazardous substances regulated by environmental laws. For example, the clause may require the seller to disclose the presence of PCBs in building materials or mandate that the buyer assumes responsibility for remediation. Its core function is to ensure compliance with environmental regulations and allocate liability for PCB-related risks, thereby protecting parties from unforeseen legal and cleanup obligations.

PCBs. Any work involving PCBs shall be accomplished in accordance with the Toxic Substance Control Act (Attachment J.1) and regulations adopted pursuant to the same, specifically 40 CFR Part 761 (Attachment J.1).
PCBs. To Seller’s knowledge, there are no polychlorinated biphenyls (“PCBs”) other than those that may be incorporated within building materials such as window caulk or glazing or friable or damaged asbestos at the Property; nor has Seller removed (or required or requested the removal of) any PCBs other than those that may be incorporated within building materials such as window caulk or glazing or damaged or friable asbestos from the Property, nor has Seller knowledge of the previous existence of any PCBs other than those that may be incorporated within building materials such as window caulk or glazing or damaged or friable asbestos at the Property.
PCBs. If polychlorinated biphenyl (PCB) containing ballasts, transformers and other electrical equipment are present in a Work area, these items must be handled by Contractor the following manner. Contractor shall provide labor and materials for proper packaging of these waste items. The Owner’s Project Manager must approve in advance the method of packaging. The packaged waste electric light bulbs will be disposed of as Hazardous Waste as provided in Section 6.6.
PCBs. The dielectric fluid in the transformers and large capacitors have been replaced with non-PCB fluids. As of 2000, disposal manifests are on file at the plant.
PCBs. Distribution and Concentration Comparison: PCBs were detected at low concentrations as four different Arochlors (1242, 1248, 1254, and 1260) in samples of leachate only (Tables 5 and 9). These Arochlor mixtures were not detected in any shallow groundwater samples or samples of surface water. This suggests that the detected PCBs are likely related to the materials in the waste management. Frequency of Detection: PCBs are generally evaluated collectively. Therefore, frequency of detection of any single arochlor is not applicable. Comparison with Water Quality Criteria: Data collected at the Site to date suggest that the PCBs are associated with the waste management unit and a comparison with water quality criteria to evaluate their inclusion as COCs is not applicable.
PCBs. Prior to the Closing Date Seller shall (i) provide Buyer copies of existing oil test results identifying any polychlorinated biphenyls for any station equipment, and (ii) allow Buyer access to station equipment with no available polychlorinated biphenyl test results, for the purpose of testing oil for polychlorinated biphenyl content.
PCBs. There are no transformers, capacitors, switches, or other ----- equipment on the Demised Premises which contain PCBs.
PCBs. The Company, CEVCO and RPC shall maintain copies of official and commercial documents concerning removal, recovery or disposal of PCBs from the Pont de Claix Site and shall, on written request, make those documents available to the other parties in the event of a dispute concerning PCBS. A list of transformers and rectifiers potentially containing PCBs is attached hereto at Schedule 3.4.8".
8. Article 4 shall be amended by the addition of a new Section 4.1.9:
PCBs. If polychlorinated biphenyl (PCB) containing ballasts, transformers and other electrical equipment are present in a Work area, these items must be handled by ▇▇▇▇ and Subcontractors in the following manner. ▇▇▇▇ shall provide labor and materials for proper packaging of these waste items. The Owner’s Representative must approve in advance the method of packaging. ▇▇▇▇ shall check each ballast, transformer and other item of electrical equipment for labeling. If there is a label on the item stating, ‘No PCB’s”, the ▇▇▇▇ may dispose of the item as non-Hazardous Waste. Otherwise ▇▇▇▇ shall package the item as provided in this Section 5.6.5.5.
PCBs. There are no polychlorinated biphenyls (“PCBs”) or friable or damaged asbestos at the Property; nor has Owner removed (or required or requested the removal of) any PCBs or damaged or friable asbestos from the Property, nor has Owner knowledge of the previous existence of any PCBs or damaged or friable asbestos at the Property.
