PEG Access Channels. 5.1.1. The Licensee shall continue to make available to the Issuing Authority and/or the PEG Access Designee, as designated in writing by the Issuing Authority, three (3) SD PEG Access Channels on its Basic Service Tier. In accordance with Section 5.1.2 below, the Issuing Authority may also request one (1) HD PEG Access Channel for a total of four (4) PEG Access Channels.
5.1.2. In addition to the three (3) SD PEG Access Channels referenced above, the Licensee shall make one (1) HD PEG Access Channel available to the Issuing Authority and/or the PEG Access Designee, as designed in writing by the Issuing Authority, as follows: Starting on the Effective Date of this Renewal License, the Issuing Authority may make a written request for such an HD PEG Access Channel to the Licensee. Upon receipt of the Issuing Authority’s written request, the Licensee shall make such an HD PEG Access Channel available to the Issuing Authority or the PEG Access Designee within two hundred and seventy (270) days of the Licensee’s receipt of such written notice. The Issuing Authority shall include in its written notice a statement of whether the programming on such HD PEG Access Channel shall either be a simulcast of existing SD PEG Access Channel programming or distinct programming. The Issuing Authority or the PEG Access Designee may subsequently change the programming on the HD PEG Access Channel from an SD PEG Access Channel simulcast to distinct programming, or from distinct programming to an SD PEG Access Channel simulcast, upon one hundred (180) days prior written notice from the Issuing Authority to the Licensee which change shall not occur more than once during the License term. To the extent permitted by law, the Licensee shall be allowed to recover from Subscribers applicable costs incurred to transmit HD PEG Access Channel programming of any type.
5.1.3. All programming content for the HD PEG Access Channel shall be transmitted to Licensee in HD-SDI format with a resolution of 720p. Licensee reserves the right to reassign channel number and location for any or all of the PEG Access Channels at any time during the term. The Issuing Authority expressly acknowledges that an HD PEG Access Channel may not be available at all times during the term of this License on Licensee’s Basic Service Tier and that in order to view the HD PEG Access Channel, a Subscriber may be required to upgrade equipment at an additional charge.
5.1.4. The Licensee may carry PEG Access Programming ...
PEG Access Channels. Any Licensee-owned channel(s) made available by the Licensee and provided for use for the presentation of PEG Access Programming.
PEG Access Channels. (a) Subject to Section 3.1 supra, no later than eighteen (18) months from the Execution Date of the Final License, the Licensee shall make available to the Issuing Authority and/or its designee(s), six (6) full-time Downstream Channels for PEG Access purposes on the Subscriber Network. There shall be no charges and/or costs whatsoever to the Issuing Authority, the Town, program originators, and/or Subscribers for such capacity.
(b) The Licensee shall make available four (4) Upstream Channels, or the equivalent thereof, for remote cablecasting of PEG Access Programming and/or interconnection to said six (6) PEG Access Downstream Channels. To the extent that one or more of said Upstream Channels are not available on the Subscriber Network, the Licensee shall make such upstream capacity available to the Town from any location on the Cable System, including any interface equipment that may be necessary on account of such upstream capacity not being on the Subscriber Network. There shall be no charges and/or costs whatsoever to the Issuing Authority, the Town, program originators, and/or Subscribers for such equivalent capacity and/or interface equipment.
(c) Said PEG Access Channels shall be used to transmit PEG Access Programming to Subscribers without charge to the Issuing Authority, its designee(s), the Town, program originators, and/or Subscribers, and shall be subject to the control and management of the Issuing Authority and/or its designee(s).
(d) Except as required by applicable law, rule or regulation, the Licensee shall employ its best efforts to use Channels 42, 47, 52, 53, 77 and 78 on the Subscriber Network as the channel locations of the PEG Access Downstream Channels. The Licensee shall not change said channel locations, without the advance, written consent of the Issuing Authority, which consent shall not be unreasonably withheld.
PEG Access Channels. (a) The Licensee shall provide two (2) PEG Access Channel(s) for non-commercial use by residents of the Town, the educational authorities, organizations serving the Town and local government officials.
(b) The Licensee shall not charge residents of the Town, educational authorities, organizations serving the Town or local or any other regional governmental entities for non- commercial use of the PEG Access channel(s).
(c) Rules shall be established by the Issuing Authority or its designee in cooperation with the Licensee regarding PEG Access Programming, priority of use of the PEG Access channel(s), the prohibition of lottery information and obscene or indecent matter (modeled after prohibitions found in other FCC rules and regulations), and permitting public inspection of a complete record of names and addressees of all persons or groups requesting time on the PEG Access channel(s). If an Access Corporation is formed pursuant to Section 6.2, the Access Corporation shall be responsible for the rules regarding PEG Access Programming.
(d) The Town may request a third PEG Access Channel when the first two channels are used to cablecast locally produced, non-duplicative, non-commercial, non-character generated programming seventy-five percent (75%) of the time between the hours of 6:00 AM and 10:00 PM six days per week for six consecutive weeks; provided, however, that specific cablecasting may be cablecast and re-cablecast a total of six (6) times during said six week period for the purposes of this Section 6.1(d). Provided that the Issuing Authority gives the Licensee three (3) months written notice, Licensee shall make such third PEG Access Channel available (i) as soon as possible if channel space is available or (ii) if there is no channel space available, Licensee shall have nine (9) months following receipt of the Issuing Authority’s request to make such third PEG Access Channel available.
PEG Access Channels. Any channel(s) made available for the presentation of PEG Access Programming.
PEG Access Channels. (a) The Licensee shall continue to make available for use by the Issuing Authority and/or its designee(s) three (3) Licensee-owned Subscriber Network Downstream Channels for PEG Access purposes, which shall be used to transmit non-commercial PEG Access Programming to Subscribers, at no cost to the Town, the Issuing Authority and/or its designee(s) and shall be subject to the control and management of the Issuing Authority and/or its designee(s).
(b) While the Licensee retains sole discretion for channel placement in accordance with terms of this Renewal License, the Licensee shall attempt to minimize the number of PEG Access Channel assignment changes. The current PEG Access Channel locations on the Basic Service Tier are 12, 15 and 17. The Licensee shall not move or otherwise relocate said channel locations of the PEG Access Channels without ninety (90) days advance, written notice to the Issuing Authority and/or its designee(s). In the event that the Licensee does relocate a PEG Access Channel(s), the Licensee shall reimburse the Town or its designee up to Three Thousand Five Hundred Dollars ($3,500) for reasonable administrative and/or technical costs incurred by the Town and/or Access Corporation as a direct result of all PEG Access Channels relocated during any given channel realignment process. Documentation of such costs shall be submitted by the Town and/or Access Corporation to the Licensee prior to any incurrence of said cost(s).
(c) The Licensee shall continue to provide the three (3) activated Downstream Channels for PEG Access use in standard digital format in the Licensee’s Basic Service. The Licensee shall carry all components of the standard definition PEG Access Channel Signal(s) provided by the Issuing Authority and/or its designee(s) including, but not limited to, closed captioning, stereo audio and other elements associated with PEG Access Programming. The Issuing Authority and/or its designee(s) shall be responsible for providing the PEG Access Channel Signal(s) in a standard definition format to the interior demarcation point at the designated point of Origination for the PEG Access Channel(s). The Licensee shall transport and distribute the PEG Access Channel Signal(s) on its Cable System and shall not discriminate against PEG Access Channels with respect to the functionality, signal quality, and features from those of the local broadcast digital format channels carried on the Cable System. PEG Access Channels. The Licensee shall provide three Channels on the Cable System for use by the Town or the Issuing Authority’s access designee(s) for the purpose of transmitting noncommercial, locally produced and locally sponsored programming by members of the public, Town departments and agencies, public schools, educational, institutional and other organizations based in the Town.
PEG Access Channels. Franchisee shall make available to the Franchise Authority, within one hundred eighty (180) days of a written request, the use of one (1) dedicated Public, Educational and Governmental (“PEG”) Access Channel in accordance with Section 611 of the Cable Act. Such PEG Channel shall be used for non-commercial PEG access programming related to educational and/or governmental activities. The County must provide Grantee with written, detailed documentation evidencing the availability of and/or plan to produce such programming along with its request. The Franchise Authority shall have complete control over the content, scheduling, administration and all other programming aspects of the PEG Channel, and may delegate such functions, or a portion of such functions, to an appropriate designee. Franchisee shall not exercise any editorial control over PEG Channel programming except Franchisee may refuse to transmit any program or portion of a public access program that contains obscenity, indecency, or nudity to the extent allowed by applicable law.
PEG Access Channels. (a) Subject to Section 7.2 (e) below, within eighteen (18) months of a written request by the Franchising Authority to the Franchisee, which request must be submitted to the Franchisee before the start of the fifth (5th) year of this Cable Television Franchise. The Franchisee shall make available to the Franchising Authority and/or its designee(s) one (1) Downstream Channel for South Berwick PEG Access use, as follows:
(b) The Franchisee shall provide the one (1) activated Downstream Channel for PEG Access use in standard digital (“SD”) format in the Franchisee’s Basic Service, the Franchising Authority and/or its designee(s) shall be responsible for providing the PEG Access Channel Signal(s) in SD format to the demarcation point at the designated point of origination for the PEG Access Channel. The Franchisee shall distribute the PEG Access Channels Signal(s) on its Cable System in SD format without substantial alteration or deterioration. The Cable System shall be capable of transmitting color video signals received at the Headend in color, stereo audio signals received at the Headend in stereo and properly formatted closed-captioned signals received at the Headend.
(c) In the event that a second PEG Access Channel is necessary for the provision of PEG Access Programming in South Berwick, the Franchising Authority shall write to the Franchisee, stating that there is a need for a second PEG Access Channel in order to provide additional programming for the benefit of South Berwick Subscribers. In its letter to the Franchisee, the Franchising Authority shall state, in good faith, the basis of such need, and provide reasonable documentation thereto. Said letter shall include the following: (1) that such a second PEG Access Channel is necessary to accomplish the stated PEG Access Programming goals of the Town; (2) that such a second PEG Access Channel will not be used simply to repeat PEG Access Programming that is already carried on the first PEG Access Channel, but will be used to carry substantially new locally-produced PEG Access Programming; and (3) that the initial PEG Access Channel is being substantially programmed (as defined below) with non- duplicated, locally-produced, non-character-generated programming during available cablecast hours, as defined below. PEG Access Channels. (a) The Licensee shall make available two (2) of its full-time channels for non- commercial, PEG Access use to the Town and/or the Town’s designee(s). Licensee shall make available a third (3rd) channel for non-commercial, PEG Access use to the Town and/or the Town’s designee within twenty four (24) months of the Effective Date of this Renewal License.
(b) Said PEG Access Channels shall be used to transmit PEG Access Programming to Subscribers without charge to the Town, the public schools, or any organizations serving the Town.
(c) The Licensee shall not change its PEG Access channel locations, without the advance, reasonable, written notification to the Issuing Authority and the Access Corporation. In the event that the Licensee does relocate one or more PEG Access Channel(s), the Licensee shall reimburse the Town or the Town’s designee responsible for said Access Channel, up to One Thousand Dollars ($1,000) for each such PEG Access Channel relocation(s), to cover said party’s actual cost therefore, such as new stationery, logos, notices, etc., with supporting documentation, prior to relocating such PEG Access Channel(s).
