Common use of Penalty Clause in Contracts

Penalty. If an Employer fails to provide payment as stated above, the Employer shall pay the Employee for waiting time in the amount of eight (8) hours per day at his regular rate of pay each regular work day delayed. Where it can be clearly shown that a clerical error in calculation or other delay beyond the control of the Employer has occurred, the Employer shall not be penalized provided the error is corrected within one (1) working day from the time of notification.
