If an employee in a non-exempt position is completing additional job duties of a position in an equivalent pay range or a lower pay range within the hour limits as defined by Colorado’s overtime laws, they are not eligible for special consideration pay. These job duties fall under “other duties as assigned.” Non-exempt positions are entitled to overtime pay if working in excess of forty (40) hours per workweek (Monday to Sunday), twelve (12) hours per workday, or twelve (12) consecutive hours without regard to the starting and ending time of the workday.
