Common use of Performance by Landlord Clause in Contracts

Performance by Landlord. If Tenant defaults or fails to perform any of its obligations under this Lease, past any applicable notice and cure period, Landlord, without waiving or curing the default or failure, may, but will not be obligated to, perform Tenant’s obligations for the account and at the expense of Tenant. Notwithstanding Section 22.2, in the case of an emergency or to prevent damage or injury or protect health, safety or property, Landlord need not give any notice before performing Tenant’s obligations. Tenant will pay on demand all costs and expenses incurred by Landlord in connection with Landlord’s performance of Tenant’s obligations after Tenant’s default and failure to cure, and Tenant will indemnify Landlord for and hold Landlord harmless from all Liabilities incurred by Landlord in connection therewith.
