Common use of PERFORMANCE BY TENANT Clause in Contracts

PERFORMANCE BY TENANT. All covenants and agreements to be performed by Tenant under this Lease shall be performed by Tenant at Tenant's sole cost and expense and without any offset to or abatement of rent. If Tenant fails to pay any sum of money, including rent, required to be paid by it hereunder or fails to perform any other act on its part to be performed hereunder, and such failure continues after written notice thereof to Tenant (if required) and the expiration of any period expressly provided for in this Lease during which Tenant may cure such failure, Landlord may, without waiving or releasing Tenant from any obligation of Tenant, make any such payment or perform any such act and all sums so paid by Landlord and all costs incurred by Landlord in performing such act (including attorneys' fees), shall be payable by Tenant on demand and Tenant hereby covenants to pay any and all such sums. Landlord shall have in addition to any other right or remedy of Landlord the same rights and remedies in the event of nonpayment of sums due under this Article XVII as in the case of default by Tenant in the payment of rent.

If Tenant fails shall fail to pay any sum of moneymoney owed to any party other than Landlord, including rentfor which it is liable hereunder, required to be paid by it hereunder or fails if Tenant shall fail to perform any other act on its part to be performed hereunder, and such failure continues shall continue for ten (10) days after written notice thereof to Tenant (if required) and the expiration of any period expressly provided for in this Lease during which Tenant may cure such failureby Landlord, Landlord may, without the obligation to do so and/or waiving or releasing Tenant from any obligation of Tenantits obligations, make any such payment or perform any such other act and all to be made or performed by Tenant. All sums so paid by Landlord and all necessary incidental costs incurred together with interest thereon at the maximum contract rate permissible by Landlord in performing law, from the date of such act (including attorneys' fees)payment by Landlord, shall be payable by Tenant to Landlord on demand and demand. Tenant hereby covenants to pay any and all such sums. , and Landlord shall have (in addition to any other right or remedy of Landlord the same Landlord) all rights and remedies in the event of the nonpayment of sums due under this Article XVII as in the case of default thereof by Tenant as are set forth in the payment of rentArticle 19 hereof.
