PERFORMANCE CAPABILITY Sample Clauses

The PERFORMANCE CAPABILITY clause defines the standards or criteria that a party must meet in fulfilling its contractual obligations. Typically, this clause outlines specific benchmarks, technical requirements, or performance metrics that the goods or services provided must achieve, such as minimum efficiency levels or compliance with industry standards. By clearly establishing these expectations, the clause ensures that both parties understand the required level of performance, reducing the risk of disputes over quality or adequacy of deliverables.
