Performance of Government Functions. Notwithstanding anything in this Agreement 681 which may be to the contrary, nothing contained in this Agreement shall in any way estop, limit or 682 impair the City from exercising or performing any regulatory, policing, legislative, governmental or 683 other powers or functions with respect to the Ballpark or otherwise, including, by way of illustration 684 but not limitation, inspection of the Ballpark in the performance of such functions and exercise of 685 the power of eminent domain with respect to the Ballpark 686
