Performance Rights. Lessee shall be responsible for payment of any and all royalties for copyrighted material used during the course of ▇▇▇▇▇▇’s event. Payment shall be deducted at final settlement and shall consist of monies withheld and due ASCAP (at the rate of .8% of Net Adjusted Gross Box Office Receipts) and BMI (at the rate of .8% of Net Adjusted Gross Box Office Receipts). The aforementioned rates are as of August 20, 2010 and subject to change. Berkshire Theatre Group will remit royalty payments on behalf of the Lessee.
