Period of Continuous Service Period of Notice. 1 year or less 1 week Over 1 year and up to the completion of 3 years 2 weeks Over 3 years and up to the completion of 5 years 3 weeks Over 5 years of completed service 4 weeks In addition to the above notice, Employees over forty-five (45) years of age at the time of the giving of the notice with not less than two years continuous service, shall be entitled to an additional week's notice. The Employer may elect to pay any or all of the notice period in lieu of the Employee working out their notice. Provided that employment may be terminated by the Employee working part of the required period of notice and by the Employer making payment for the remainder of the period of notice. The required amount of payment in lieu of notice shall equal the amount the Employer would have been required to pay the Employee had they worked through their notice period. That above amount shall be calculated on the basis of the employee's ordinary hours of work. The period of notice in this clause shall not apply in the case of dismissal for serious misconduct to Casual or Fixed-term Employees.

In calculating any payment in lieu of notice, the amount the Employer wages to be used will be those an Employee would have been required to pay the Employee had they worked through their notice period. That above amount shall be calculated on the basis received in respect of the employee's ordinary hours time (including relevant allowances) they would have worked during the period of worknotice had their employment not been terminated. The period of notice in this clause shall not apply in the case of dismissal for serious misconduct to Casual conduct which justifies instant dismissal or Fixed-term in the case of casual Employees, or apprentices or those Employees engaged for a specific period of time or for a specific task or tasks.

That above amount shall be calculated on the basis received in respect of the employee's ordinary hours of work. The time the employee would have worked during the period of notice in this clause had the employee’s employment not been terminated. The above stated period of notice shall not apply in the case of dismissal for serious misconduct to Casual conduct that justifies instant dismissal including malingering, inefficiency or Fixed-term Employeesneglect of duty, or in the case of casual employees. Upon termination of employment, wages due shall be paid within 3 working days of the day of such termination or forwarded by electronic transfer on the next working day.
