Common use of Permit Blocking Clause in Contracts

Permit Blocking. Neither Purchaser nor any of its Affiliates has been notified (nor is there any pending or threatened notification) by the United States Office of Surface Mining, Reclamation and Enforcement or the agency of any state administering SMCRA that Purchaser or any of its Affiliates is (i) ineligible to receive surface mining permits, or (ii) under investigation to determine whether its eligibility to receive a SMCRA permit should be revoked, or (iii) otherwise permit blocked.

Permit Blocking. Neither Purchaser Buyer nor any of its --------------- Affiliates has been notified (nor to the Knowledge of Buyer is there any pending or threatened notification) by the United States Federal Office of Surface Mining, Reclamation and Enforcement Mining or the agency of any state administering SMCRA that Purchaser Buyer or any of its Affiliates is (i) ineligible to receive surface mining permits, or (ii) under investigation to determine whether its eligibility to receive a SMCRA permit should be revoked, or revoked (iii) otherwise permit blocked.i.

Neither Purchaser Seller nor any of its Affiliates Subsidiary has ---------------- been notified (nor to the Knowledge of Seller is there any pending or threatened notification) by the United States Federal Office of Surface Mining, Reclamation and Enforcement Mining or the agency of any state administering SMCRA that Purchaser or any of its Affiliates it is (i) ineligible to receive additional surface mining permits, permits or (ii) under investigation to determine whether its eligibility to receive a SMCRA permit should be revoked, or revoked (iii) otherwise permit blocked.i.
