Permitted License Uses and Restrictions. a. Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to use the Software solely on the designated model(s) of nextScan branded devices purchased from nextScan or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tablets, and other mobile devices) and/or your networks, which are in either case solely within your control, and in every case solely for purposes of using the Approved Devices. This License does not grant you any rights to use the Software or other nextScan proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from nextScan. b. Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by nextScan for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device that you do not control or own. c. You may not, and you agree not to permit or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Software or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-source components that may be included with the Software). You have the right to make copies of the Software for archival purposes; however such copies remain subject to the terms and conditions of this License; and must include all trademark, copyright, patent, and other notices and legends contained in the original. d. You agree to use the Software in compliance with all applicable laws, including local laws of the country(ies) or region(s) in which you reside and in which you download and use the Software. Features of the Software may not be available in all languages or regions, some features may vary by region, and some may be restricted or unavailable. e. You shall not directly or indirectly (i) remove, delete, alter, or obscure any copyright, trademark, patent, or other intellectual property or proprietary rights notices provided on or with the Software; (ii) use the Software to cause immediate, material or ongoing harm; (iii) remove, disable, circumvent, or otherwise create or implement any workaround to any technical limits or technological copy protection or other security features of the Software; (iv) publish the Software for others to copy, except in connection with a permitted use of Approved Devices (provided the Software must be the most current version available from nextScan, including all available Updates); or (v) use the Software for purposes of competitive analysis of the Software, the development of a competing software product or service, or any other purpose that is to nextScan’s, or its licensors’ or suppliers’, commercial disadvantage.

This License does not grant you any rights to use the Software or other nextScan proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from nextScan. b. Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by nextScan for your model(s) of the Approved Devices to update or restore the FileMaker Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a Apple-branded iOS device that you do own or control. You may not control distribute or ownmake the FileMaker Software available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the FileMaker Software. You may use this Software to access data stored on FileMaker Server or FileMaker Cloud for AWS if you have purchased access rights under one of the Claris volume license programs (e.g. FileMaker Site License, FileMaker User License, etc.). The terms of the applicable Claris volume license agreement will govern your access rights. c. (b) You may not, not and you agree not to, or to permit or enable others to, copy (except as expressly permitted by this LicenseLicense and the "Usage Rules"), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the FileMaker Software or any services provided by the FileMaker Software, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of open-source any open sourced components that may be included with the FileMaker Software). Features of the Software may not be available in all languages or regions, some features may vary by region, and some Such content may be restricted or unavailable. e. You shall not directly or indirectly (i) remove, delete, alter, or obscure any copyright, trademark, patent, protected by copyright or other intellectual property laws and treaties, and may be subject to terms of use of the third party providing such content. This License does not grant you any rights to use such content. For example, any stock photographs, images, graphics, clipart, artwork or proprietary rights notices similar assets (“Digital Imagery”) that are provided by Claris and/or its licensors as part of the FileMaker Software or Services (including but not limited to any Digital Imagery contained within templates, themes or user guides and tutorials) may not be extracted and distributed, commercially or otherwise, on a standalone basis outside of the FileMaker Software. (d) Any financial or health information displayed by the FileMaker Software is provided for general informational purposes only and is not intended to be relied upon as, or a substitute for, financial or medical advice. You are solely responsible for the financial or health decisions made by you and any consequences resulting therefrom, and should always seek the guidance and advice of a financial or medical professional as appropriate. Neither Claris nor any of its licensors guarantees the accuracy, completeness, or timeliness of financial or health information appearing within the FileMaker Software or that desired results will be obtained. (e) Certain components of the FileMaker Software, and third party open source programs included with the FileMaker Software, have been or may be made available by Claris on its web site (▇▇▇▇://▇▇▇.▇▇▇▇▇▇▇▇▇.▇▇▇/support/downloads/?nav=support- downloads) (collectively the "Open-Sourced Components"). You may modify or replace only these Open-Sourced Components; provided that: (i) the resultant modified FileMaker Software is used in accordance with the permitted uses set forth above; and (ii) you otherwise comply with the terms of this License and any applicable licensing terms governing use of the Software Open- Sourced Components. Claris is not obligated to cause immediateprovide any maintenance, material or ongoing harm; (iii) remove, disable, circumvent, or otherwise create or implement any workaround to any technical limits or technological copy protection or other security features of support for the resultant modified FileMaker Software; (iv) publish the Software for others to copy, except in connection with a permitted use of Approved Devices (provided the Software must be the most current version available from nextScan, including all available Updates); or (v) use the Software for purposes of competitive analysis of the Software, the development of a competing software product or service, or any other purpose that is to nextScan’s, or its licensors’ or suppliers’, commercial disadvantage.

This License does not grant you any rights to use the Software or other nextScan Digital Check proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from nextScanDigital Check. b. (b) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by nextScan Digital Check for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device that you do not control or own. c. This License does not grant you any rights to use the Software or other nextScan ST Imaging proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from nextScanST Imaging. b. Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to download Software and Updates that may be made available by nextScan ST Imaging for your model(s) of the Approved Devices to update or restore the Software on or for any such Approved Device that you own, control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device that you do not control or own. c. Permitted License Uses and Restrictions. a. (a) Subject to the terms and conditions of this license, you are granted a limited non exclusive license to use the Software. Except as permitted in Section 2 (b) below, and except as provide in a separate agreement between you and SWAG, this License does not allow the Software to exist on more than one device at a time, and you may not distribute or make the Software available over a network where it could be used by multiple devices at the same time. This license does not grant you any rights to use SWAG proprietary interfaces and other intellectual propriety in the design, development, manufacture, licensing or distribution of third party devices and accessories, or third party software applications for use with Application. (b) Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to use the Software solely on the designated model(s) of nextScan branded devices purchased from nextScan or its authorized resellers (“Approved Devices”) and, as applicable, on your associated workstations (including computers, tablets, and other mobile devices) and/or your networks, which are in either case solely within your control, and in every case solely for purposes of using the Approved Devices. This License does not grant you any rights to use the Software or other nextScan proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories. Some of those rights are available under separate licenses from nextScan. b. Subject to the terms and conditions of this License, you are granted a limited non-non exclusive license to download Software and Updates that may be made available by nextScan SWAG for your model(s) model of the Approved Devices device to update or restore the Software software on or for any such Approved Device device that you own, own or control, or support on behalf of the end user of the Device. This License does not allow you to update or restore any Software for a device Application that you do not control or own, and you may not distribute or make the Software Updates available over a network where they could be used by multiple devices or multiple computers at the same time. c. (c) You may not, and you agree not to permit or enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative derivatives works of the Software or any part thereof (except as and only to the extent extend any foregoing restriction is prohibited by applicable law or by licensing terms governing use of open-open source components that may be included with the Software). You have agree not to remove, obscure or alter any proprietary notices (including trademark and copyright notices) that may be affixed to or contained within the right Software. (d) The Software may be used to make copies reproduce materials so long as such use is limited to reproduction of non copyrighted materials, materials in which you own the copyright, or material you are authorized or legally permitted to reproduce. Title and intellectual propriety rights in and to any content displayed by, stored on or accessed through your Application belong to the respective content owner. Except as otherwise provided herein, this License does not grant you any rights to the terms and conditions of this License; and must include all trademark, copyright, patent, and other notices and legends contained in the originaluse such content nor does it guarantee that such content will continue to be available to you. d. In addition you acknowledge that many features and Services of the Software for others to copy, except in connection with a permitted use of Approved Devices (provided the Software must be the most current version available from nextScantransmit and receive data, including all available Updates); or app downloads and updates, and could impact charges to your data plan. Accordingly, you are responsible for any such charges. You can control which applications are permitted to use cellular data and view an estimate of how much data such application have consumed under Cellular Data Settings. For more information, please consult the User Guide for your Application. (vg) use Using Application in some circumstances can distract you and may cause a dangerous situation. By using the Software application you agree that you are responsible for purposes observing rules applicable to your country of competitive analysis of the Software, the development of a competing software product or service, or any other purpose that is to nextScan’s, or its licensors’ or suppliers’, commercial disadvantageresidence.

This License does not grant you any rights to use the Software or other nextScan proprietary interfaces and other intellectual property in the design, development, manufacture, licensing or distribution of other devices and accessories, or software applications, for use with Approved Devices or other devices and accessories.
