The Concessioner shall be accountable to the Director for the government personal property assigned to it and shall be responsible for maintaining the property as necessary to keep it in good and operable condition. If the property ceases to be serviceable, it shall be returned to the Director for disposition.

(i) Tugs and Trams Used for On-Island Transportation. As the tugs and trams will require rehabilitation or replacement within the term of the Contract, the Concessioner must rehabilitate them or acquire new ones. If the Concessioner acquires new tugs or trams, the new equipment, as identified in Exhibit E, must be sold to the successor concessioner during Contract transition for a price no greater than the original purchase price less 6.0% of the original purchase price for each year or partial year of operation.
