Petition for review. Any party to proceedings before the European Patent Court which is adversely affected by a decision against which an appeal is not or no longer possible may file a petition for review of that decision by the Court of Appeal.
Petition for review. Any party aggrieved by the Decision of the Regional Officer, on any legal ground and upon payment of the review fee may file with the Regional Office a verified Petition for Review of such decision within thirty (30) calendar days from receipt thereof. In cases decided by the Executive Committee pursuant to Rule II, Section 2 of these Rules, as amended, the verified Petition shall be filed with the Executive Committee within thirty (30) calendar days from receipt of the Committee’s Decision. Copy of such petition shall be furnished the other party and the Board of Commissioners. No motion for reconsideration or mere notice of petition for review of the decision shall be entertained. Within ten (10) calendar days from receipt of the petition, the Regional Officer, or the Executive Committee, as the case may be, shall elevate the records to the Board of Commissioner together with the summary of proceedings before the Regional Office. The Petition for Review of a decision rendered by the Executive Committee shall be taken cognizance of by the Board en banc.

(1) Decisions given by the Court of Appeal under Article 45 may be subject to further review by the Court of Justice of the European Communities on points of law only, in accordance with the Statute.
(2) A petition for review shall have no suspensive effect.
Petition for review. 18. On March 8, 2021, the Parties filed a joint motion to ▇▇▇▇▇ ▇▇▇▇▇▇ Midstream’s appeal in the Fifth Circuit, and on March 10, 2021, the Court responded by dismissing the Petition for Review, without prejudice to the right of either party to reinstate the petition within 180 days. The Parties agree that this Agreement resolves all disputed issues in this proceeding, that no party may reinstate the Petition for Review in the U.S. Court of Appeals for the Fifth Circuit, and that each party shall bear its own costs for the previously-filed Petition for Review.

(1) Any party to proceedings before the European Patent Court which is adversely affected by a decision against which an appeal is not or no longer possible may file a petition for review of that decision by the Court of Appeal.
(2) The petition for review may only be filed on the grounds that
(a) a criminal act may have had an impact on the decision, or,
(b) if it concerns a decision of the Court of Appeal, a fundamental procedural defect has occurred in the proceedings.
(3) A petition for review may only be based on paragraph 2(a) if a competent court or authority has finally established that a criminal act occurred; a conviction is not necessary.
(4) The petition for review shall be filed in accordance with the Rules of Procedure. See Art. 112a(4) EPC
(5) If based on paragraph 2(b), the petition shall be filed within two months of notification of the decision. If based on paragraph 2(a), the petition shall be filed within two months of the date of the decision establishing the criminal act and in any event no later than five years from notification of the decision of the European Patent Court. See Art. 112a(3) EPC
(6) The petition for review shall not have suspensive effect unless the Court of Appeal decides otherwise.
