Phase I and Phase. II Environmental Assessments of Community Bank's Primary Banking Facility. CBES hereby agrees that NASB Holding may cause to be performed a Phase I and Phase II environmental assessment of the real property on which Community Bank's primary banking facility is located (1001 North ▇▇▇▇▇ ▇▇▇▇▇ Road, Excelsior Springs, Missouri 64024). If as a result of such assessment it is determined that environmental clean-up costs would exceed $500,000, then NASB Holding may elect to terminate this Agreement pursuant to Section 7.1(h).

Phase I and Phase. II environmental assessments of the Real Property of E.P. Plastics and Goodyear Composites acquired pursuant to the Acquisitions, from ▇▇▇▇▇▇▇ Environmental Consultants, the results of which shall be in form and substance satisfactory to the Agent and the Required Banks; and
Phase I and Phase. II Environmental Assessment Reports prepared by Applied Geosciences, Inc., dated February 7, 1995, and February 13, 1995, respectively.
Phase I and Phase. 2 PREMISES The Landlord hereby leases to the Tenant the Phase 1 and Phase 2 Premises comprised of approximately 30,400 square feet of the total space, and more specifically as shown on Schedule "A", as adjusted and verified in accordance with paragraph 1(h) of this Lease Amendment ("Leased Premises") on the terms and conditions as follows:
(a) TERM The term of this Lease Amendment shall be for three (3) years commencing on September 1 ,2006 (the "Commencement Date"), and expiring on the 31st day of August, 2009 (the "Lease Term"). It is agreed that the Lease Term shall automatically renew in one-year increments for five (5) additional years, unless the Landlord is notified otherwise by the Tenant. It is further agreed between the parties that the Tenant may terminate the Lease on six month's written notice to the Landlord after the expiration of the third year of the Lease.
Phase I and Phase. II Environmental Assessment Reports with respect to Accura, each dated reasonably near the date of such Borrowing, and the Borrower and/or Accura shall have obtained Environmental Permits necessary to operate the business of Accura and Accura shall maintain its operations in compliance with such permits;
Phase I and Phase. III of the development shall consist of the following uses and dwelling types:
a) a maximum of 66 dwelling units, to be comprised of any combination of:
i) a maximum of 30 townhouse dwelling units in a maximum of 10 structures with no more than three units per structure;
ii) a maximum of 36 semi-detached dwelling units in a maximum of 18 structures; and
iii) single-detached dwelling units; and
