Common use of PIK Notes Clause in Contracts

PIK Notes. In connection with any PIK Payment, the Issuer is entitled, without the consent of the Holders (and without regard to any restrictions or limitations set forth in Section 4.09 of this Indenture and Section 4.12 of this Indenture), to issue PIK Notes in the form of Definitive Notes under this Indenture having the same terms as the Initial Notes or the Additional Notes, as applicable, subject to Section 2.14 of this Indenture, in the amount of the applicable PIK Payment.

PIK Notes. In connection with any the payment of PIK PaymentInterest in respect of the Notes, the Issuer is entitledentitled to, without the consent of the Holders (and without regard to any restrictions or limitations set forth in Section under Sections 4.09 of this Indenture and Section 4.12 of this Indenturehereof), to increase the outstanding principal amount of the Notes or issue additional Notes (the “PIK Notes in the form of Definitive Notes Notes”) under this Indenture having on the same terms and conditions as the Initial Notes or the Additional Notes(in each case, as applicable, subject to Section 2.14 of this Indenture, in the amount of the applicable a “PIK Payment”).
