Planned Outage Schedule. Not less than fifteen (15) Business Days prior to the start of the Total Supply Period and to each subsequent anniversary thereof, the Seller shall provide to the Buyer a schedule setting out each of the Planned Outages in the forthcoming year ("Planned Outage Schedule"). 4. Planned Outage Schedule. The Parties shall develop a Planned ----------------------- Outage Schedule no later than October 1, for the twenty-four (24) month period beginning January 1 of the following year for the Facilities. Generating Company shall submit its initial proposed Planned Outage Schedule no later than September 1 for the following two (2) calendar years. This will allow Transmission Provider one (1) month to work out any conflicts according to the process identified in Section 3.10.5 below. The schedule submitted to the Transmission Provider shall include all Units 10 MVA or larger and all Interconnection Equipment and associated radial facilities. Subsequently, after the first of the year, each month the schedule shall have a new month added so as to maintain a rolling twenty-four (24) month period. If a proposed outage is expected to continue beyond the month that was submitted, then the complete duration of the proposed outage shall also be submitted. The rolling twenty-four (24) month proposed Planned Outage schedules shall be reviewed by Transmission Provider as they are received and will attempt to resolve any conflicts at that time, with the finalized schedule being issued no later than October 1 for the following two (2) calendar years. The Parties agree to meet to review the efficacy of the procedures in Sections 3.10.2 through 3.10.5 twelve (12) months after the Effective Date of this Agreement and to seek agreement on any necessary changes. Pending the Transmission Provider's filing at FERC of its proposed treatment of data provided to Transmission Provider , and FERC's acceptance of such proposed treatment, data provided pursuant to this Section will be treated as Confidential Information in accordance with Article 20.

Planned Outage Schedule. Seller will develop and implement, or cause to be developed and implemented, a planned outage and maintenance schedule for the Project that is reasonably acceptable to Buyer.

Planned Outage Schedule. Seller will develop and implement, or cause to be developed and implemented, an annual scheduled outage program for each Facility. Seller will review with Buyers the annual scheduled outage program for each such Facility by no later than one hundred and thirty (130) days prior to the start of each PJM Delivery Year. Seller agrees to notify Buyers of changes to the scheduled outage program as soon as is reasonably practicable.

Planned Outage Schedule. The Authority shall procure that the Generator shall, not less than 15 Working Days prior to the start of each Contract Year, provide to the Supplier a schedule (in a form required by the Supplier, acting reasonably) setting out each of the proposed Planned Outages in the relevant Contract Year, including details as to the amount by which the Net Capacity of the Facility will be reduced and the nominated timing and dates of such Planned Outages (“Planned Outage Schedule”). The Generator may amend the Planned Outage Schedule for any Contract Year (by resubmitting the form referred to in Paragraph 4.1 provided it does so as far in advance of the Planned Outage that is to be revised by such amendment as reasonably possible. In nominating the number, timing and duration of Planned Outages to be included in a Planned Outage Schedule and in proposing any amendments to such Planned Outage Schedule, the Authority shall procure that the Generator shall consider the benefit to each Party of avoiding Outages during the Months of November to February (inclusive) insofar as reasonably practicable. The Authority shall procure that the Generator shall consult with the Supplier during the period in which the Generator is preparing each Planned Outage Schedule and any amendments thereto, to ascertain the Supplier’s preferences, provided that the final decision with regards to scheduling Planned Outages shall rest with the Generator. Disputes regarding the Authority’s compliance with Paragraph 4.1 to 4.4 shall be resolved in accordance with Clause 16.
