Common use of Port’s Right to Perform Clause in Contracts

Port’s Right to Perform. Upon Tenant’s failure to perform any obligation or make any payment required of Tenant hereunder, the Port shall have the right (but not the obligation) to perform such obligation of Tenant on behalf of Tenant and/or to make payment on behalf of Tenant to such parties. Tenant shall reimburse the Port the reasonable cost of the Port’s performing such obligation on Tenant’s behalf, including reimbursement of any amounts that may be expended by the Port, plus interest at the Default Rate.
