POS Terminal. You are responsible for any use made of your points of sale terminal. You shall immediately inform PSiGate if your point of sale terminal is not functioning normally. PSiGate is permitted to presume that all Transactions initiated on your point of sale terminal have been authorized by you and the Cardholder of the Card used for the Transaction. You assume full and exclusive responsibility for any use of the passwords or access codes to your point of sale terminal and to the Software. You undertake to change such passwords from time to time.
POS Terminal an electronic software and/or technical equipment used 1) to withdraw money from the service provider's/bank’s office; and/or 2) for making payments by card instrument in trade/service outlets, which may include cash withdrawals in addition to payment for goods/services (except for e-commerce transactions).

Licensee shall immediately return such POS Terminal to Sears upon demand. Sears shall have the right to take possession of the POS Terminal at any time without giving prior notice to Licensee.

Licensee shall ensure that it records all transactions on Licensee’s store automation system (“SAS”) and the Sears POS Terminal.

  • Vendor’s Termination If TIPS fails to materially perform pursuant to the terms of this Agreement, Vendor shall provide written notice to TIPS specifying the default (“Notice of Default”).
