Common use of Possession and Enjoyment Clause in Contracts

Possession and Enjoyment. From and after the acquisition by the City of the Property in accordance with the terms of the Lease Agreement, the City shall during such Lease Term peaceably and quietly have and hold and enjoy the Property, without suit, trouble or hindrance from the Trustee, except as expressly set forth in the Lease Agreement. The Trustee will, at the written request of the City and at the City’s cost, join in any legal action in which the City asserts its right to such possession and enjoyment, to the extent Trustee lawfully may do so; provided, however, the Trustee may decline to join in such action if it believes it will be exposed to liability for which it has not been satisfactorily indemnified against. 34 Section V.18 Tax Covenants. 34
