Post-Construction Phase. A. Upon written authorization from Owner during the Post-Construction Phase, Engineer shall: 1. Together with Owner, visit the Project to observe any apparent defects in the Work, make recommendations as to replacement or correction of defective Work, if any, or the need to repair of any damage to the Site or adjacent areas, and assist Owner in consultations and discussions with Contractor concerning correction of any such defective Work and any needed repairs. 2. Together with Owner, visit the Project within one month before the end of the Construction Contract’s correction period to ascertain whether any portion of the Work or the repair of any damage to the Site or adjacent areas is defective and therefore subject to correction by Contractor. 3. Full payment of the final invoice will not be considered until the consultant has electronically furnished the following documents: a) The city’s semi-final inspection letter stating the date of semi-final inspection and listing those who were present. b) The city’s final acceptance letter showing the number of working days or calendar days charged, completion date and the amount of liquidated damages, if any. c) A final list of acceptance testers used on the project and a certification stating: “The results of the tests or acceptance samples indicate that material incorporated in the construction work and the construction operations controlled by sampling and testing were in reasonably close conformity with the approved plans and specifications, and such results compare favorably with the results of independent assurance sampling and testing.” Any deviations from the specifications must be explained along with the reason for acceptance. “All field tests were performed in conformity with the governing specifications and the results were in reasonably close conformity with the specifications.” Explain any deviations and why the work was accepted. “The project was constructed substantially in conformity with the plans and specifications for the project.” d) Contractor certification and city recommendation: Showing the final DBE participation on the project including the DBEs used, the type of work performed, and the dollar amount paid to each DBE. Post-Construction Phase. In the event a contractor’s claims review board is convened involving this project, the Architect/Engineer shall assist the Trustees in producing its rebuttal and attend the claim board hearing. Based on claims review board findings the Trustees at their discretion may authorize payment consistent with 3.0g to Architect/Engineer for reasonable efforts expended in this regard. The Post Construction Phase shall end upon the public filing of the Notice of Completion.
Post-Construction Phase. The post construction phase as to each construction contract shall commence on the date of the Certificate of Substantial Completion and will end after all defective, deficient or incomplete items are rectified or completed to the satisfaction of the Professional Services Consultant and the Owner. The Professional Services Consultant shall specifically indicate in writing what equipment has been turned off or disconnected and when equipment settings are found to be different from the requirements in the operation and maintenance manuals. b. The Professional Services Consultant shall conduct an evaluation of the complete Project and meet with the Owner’s personnel to review any problems being experienced no later than eleven (11) months after the date of Substantial Completion of the Project. A written report shall be given promptly to the Owner and the Contractor(s) describing conditions that are to be corrected by the Contractor(s) including a completion date, and any general observations on the Project’s continuing ability to meet its intended use. The Professional Services Consultant shall follow up after the scheduled completion date(s) to confirm the Contractor(s) have completed their Work and shall report thereon to the Owner in writing. If any such condition has not been corrected, the process shall be repeated until it has been corrected. c. Post-Construction Phase. The Post Construction Phase will commence upon the Substantial Completion of the Project (including issuance of Architect’s certifications with respect thereto) and shall be completed upon the expiration of the guarantee/warranty period under the Construction Contract, which is anticipated to be not less than one year following Substantial Completion (the “GC Warranty Period”). During the Post-Construction Phase, Architect shall perform the following services within the times specified under each of the following subsections. 5.5.1 Architect shall prepare a set of CADD Disks of drawings showing changes in the Work made during the construction process, based on neatly and clearly marked- up contract drawings, prints, and other data furnished by the Contractors and the applicable addenda, clarifications and Change Orders which occurred during the Project. Said CADD disks shall be delivered to Developer, and additional copies to the Owner, within sixty (60) days of Substantial Completion or within sixty (60) days after receipt of data from General Contractor, whichever is later. 5.5.2 Architect shall provide assistance to Developer in the original operation of any equipment or system in the Project, such as initial start-up, testing, adjusting and balancing. 5.5.3 Architect and its Subconsultants shall observe and review test data of the original operation of any equipment or system in the Project, such as initial start-up testing, adjusting and balancing, to make sure that all equipment and systems are properly installed and functioning in accordance with the design and specifications. Architect shall promptly notify Developer of any failure of systems and equipment to comply with the requirements herein. 5.5.4 Architect shall review for completeness the General Contractor and Separate Prime Contractor furnished maintenance and operating instructions, schedules, guarantees, bonds, and certificates of inspection as required by the Contract Documents and forward all approved copies to Developer. Architect’s review and subsequent turnover of such documents shall occur within fifteen (15) days of Architect’s receipt of documents from the Contractors.
