Common use of Postponement or Cancellation Clause in Contracts

Postponement or Cancellation. The Cure Starts Now and Brew- Ha- Ha shall not be liable for any damages or expenses incurred by Exhibitors if the event rented space cannot be occupied; the festival is delayed, interrupted, or not held as scheduled for any reason beyond reasonable control of The Cure Starts Now and Brew- Ha- Ha. The Cure Starts Now and Brew- Ha- Ha may retain as much of the amount paid by Exhibitors as is deemed necessary to defray expenses already incurred by The Cure Starts Now and Brew- Ha- Ha. The event will be held rain or shine. If Exhibitor fails to occupy rented space by 2:00PM or fails to comply in any other respect with the terms of this agreement The Cure Starts Now and Brew- Ha- Ha shall have the right to use such space. No refunds will be made if space or portion of space is not used.
