Common use of Powers in augmentation Clause in Contracts

Powers in augmentation. The powers conferred on a Secured Party or a Controller by law: (a) except as specified in clause 21.2, are in addition to the Powers conferred by this Deed or any Transaction Document; (b) to the extent permitted by law, may be exercised immediately upon an Event of Default that is subsisting; and (c) are excluded or varied only so far as they are inconsistent with the express terms of this Deed or any Transaction Document.

Powers in augmentation. The powers conferred on a Secured an Enforcing Party or a Controller by law: (a) except as specified in clause 21.2, are in addition to the Powers conferred by this Deed or any Transaction Facility Document; (b) to the extent permitted by law, may be exercised immediately upon an Event of Default that occurring and at any time whilst it is subsistingcontinuing; and (c) are excluded or varied to the extent permitted by law only so far as they are inconsistent with the express terms of this Deed or any Transaction Facility Document.
