Common use of PREAMBLE/PURPOSE Clause in Contracts

PREAMBLE/PURPOSE. Section 1.1. This Agreement, entered into by the City of ▇▇▇▇▇ Heights, Ohio, hereinafter referred to as the "Employer," and the ▇▇▇▇▇ Heights Firefighters Local 2926, International Association of Firefighters (OAPFF), AFL-CIO, hereinafter referred to as the "Union," has as its purpose the following: Section 1.2. In case of emergency declared by the President of the United States, the Governor of the State of Ohio, the Sheriff, City Manager, Mayor, City Council, or the Federal or State Legislature, such as acts of God or civil disorder, the following conditions of this Agreement may be temporarily suspended by the Employer: A. Time limits for the processing of grievances; and B. Selected work rules and/or agreements and practices relating to the assignment of employees. Section 1.3. This Agreement supersedes and replaces all pertinent statutes, ordinances, resolutions, rules, and regulations over which it has authority to supersede and replace. Where this Agreement is silent, the provisions of applicable law shall prevail. If a court of competent jurisdiction finds any provision of this Agreement to be contrary to any statute, such provision shall be of no further force and effect, but the remainder of the Agreement shall remain in full force and effect.
