Common use of Preferred Share Clause in Contracts

Preferred Share. For the purposes of this Section 14(b), the current market value of a Preferred Share shall be the closing price of a Preferred Share (as determined pursuant to the second sentence of Section 11(d)(i) hereof) for the Trading Day immediately prior to the date of such exercise.

Preferred Share. For the purposes of this Section 14(b), the current market value of a Preferred Share shall be the closing price of a Preferred Share (as determined pursuant to the second sentence of Section 11(d)(i) hereof) for the Trading Day immediately prior to the date of such exercise; provided, however, that if the Preferred Shares are not publicly traded at the time of such exercise, the current market value of a Preferred Share shall be determined in accordance with Section 11(d)(ii) hereof for the Trading Day immediately prior to the date of such exercise.

Preferred Share. For the purposes of this Section 14(b), the current market value of a Preferred Share shall be one thousand times the closing price of a Preferred Share share of Common Stock (as determined pursuant to the second sentence of Section 11(d)(i) terms hereof) for the Trading Day immediately prior to the date of such exercise.

Preferred Share. For the purposes of this Section 14(b15(b), the current market value of a Preferred Share shall be the closing price of a Preferred Share (as determined pursuant to the second sentence of Section 11(d)(i1l(d)(ii) hereof) for the Trading Day immediately prior to the date of such exercise.

Preferred Share. For the purposes of this Section 14(b15(b), the current market value of a Preferred Share shall be the closing price of a Preferred Share (as determined pursuant to the second sentence of Section 11(d)(i11(d)(ii) hereof) for the Trading Day immediately prior to the date of such exercise.
